FA-45 <br />language, and there are frequent opportunities to use graphics to illustrate Code <br />provisions to enhance understanding for the reader. <br />Staff has compiled five initial groupings of provisions to be amended to remedy <br />identified problems in the Zoning Ordinance. The City has contracted with Curtis <br />Williams, a local planning consultant, to review these provisions, analyze options <br />to address those concerns, and work with staff to develop proposed revisions to <br />current language. Mr. Williams has worked closely with Planning staff over the <br />past few months to develop these proposals, and has also coordinated his <br />review with the Engineering and Building staff, as well as with the City Attorney's <br />office and the City's Child Care Coordinator. <br />The Planning Commission's role in the review of the proposed amendments is to <br />adopt a Resolution of Intention, conduct a public hearing, review the proposed <br />Zoning Ordinance text amendments, and make recommendations to the City <br />Council. The Council will then conduct a public hearing and take final action on <br />the proposed amendments. Additional zoning ordinance amendments are also <br />being reviewed by staff and the consultant for future consideration by the <br />Commission and Council. <br />ZONING ADMENDMENT PROCESS <br />As set forth in Section 41.2 (a). of the Zoning Ordinance, Zoning Text <br />Amendments may be initiated by Resolution of Intention by the Planning <br />- Commission. The Zoning Ordinance further requires that a public hearing on the <br />Resolution of Intention be held within 45 days of the adoption of the subject <br />Resolution by the Planning Commission. At the conclusion of the public hearing <br />on the proposed amendment(s), the Planning Commission must then take action <br />as set forth in Section 41.5 of the Zoning Ordinance: <br />a) If the Commission finds that the proposed amendment is not in the public <br />interest, the Commission can, in this case, terminate the proceedings. <br />b) If determined that the proposed amendment is in the public interest, then <br />the Commission can make a recommendation to the City Council to adopt <br />the proposed amendment (with or without modifications). <br />c) Either way, (in the case of a Resolution of Intention by the Planning <br />Commission), the Commission action is not appealable to the City <br />Council. <br />Staff has scheduled and publicly noticed both the adoption of Resolution of <br />Intention and the required public hearing on the proposed Zoning Text <br />amendments during the same Planning Commission meeting on May 6 <br />(technically the public hearing does occur "within 45 days" following the adoption <br />of the Resolution of Intention). In the future, seeking to improve on the <br />amendment process, Resolution of Intentions and related public hearings on <br />proposed amendments will be scheduled on separate Planning Commission <br />meeting dates (and within 45 days from adoption of the Resolution of Intention of <br />the Planning Commission). <br />2 <br />
