However, in <br />this case, DMV determined that such access is <br />authorized only for law enforcement personnel <br />who work for public agencies and who have been <br />identified as peace officers. Employees of city <br />attorney offices do not qualify under that standard. <br />DMV reports that it maintains a 24 -hour telephone <br />hotline for law enforcement personnel who may <br />need access to driver's license and vehicle <br />registration records, such as photographs and <br />fingerprints, on an emergency basis. There is a <br />concern that if this service is used for nonessen- <br />tial and non - emergency purposes, the system <br />may become overloaded. DMV also points out <br />that city attorney can, and do, get immediate <br />access to these records by working in concert <br />with their local police departments, which already <br />have the statutory authority to request the records <br />by phone. AB 365 was amended in the Senate <br />Public Safety Committee so that the language in <br />the bill made clear that access should be limited <br />to City Attorneys prosecuting pursuant to govem- <br />ment code Section 41803.5. Taxicabs <br />and Passenger Vehicles for Hire. Violations. <br />Impoundment. Charter -Party Carriers of <br />Passengers. Advertisement as Taxicabs. <br />AB 299 requires a magistrate, when presented <br />with an affidavit from a peace officer establishing <br />reasonable cause to believe that a vehicle is being <br />operated as a "for hire" taxicab or passenger <br />vehicle in violation of local licensing requirements, <br />to issue a warrant or authorize the peace officer to <br />seize the vehicle in question. It also requires that <br />the vehicle be impounded for a period up to 30 <br />days, with the impounding agency notifying, within <br />two working days, the legal owner of the vehicle. <br />Additionally, AB 299 was amended to prohibit a <br />charter -party carrier of passengers from advertis- <br />ing or otherwise representing their services to the <br />public, as a taxicab or taxi service. Per- <br />sons with Disabilities. Violations. AB 327 <br />increases the penalty for violating statues related <br />to disabled persons' parking privileges. AB 327 <br />raises from $250 to $500 the minimum fine for the <br />improper use of disabled persons' distinguished <br />license plates or placards. It also raises from <br />$250 to $500 the minimum fine for illegally parking <br />in a stall or space designated for disabled persons <br />and disabled veterans. The author points out that <br />current punishment for abusing disabled placards <br />were established in 1992 and are increasingly <br />failing to serve as an effective deterrent. Assem- <br />bly Member Runner believes that the low mini- <br />mum fines encourage people to take their <br />chances when faced with otherwise limited <br />parking opportunities. Therefore raising the <br />minimum fine will serve as a deterrent as well as <br />raise local revenues. AB 150 clarifies that a person required to <br />register as a convicted sex offender who violates <br />more than one requirement of the sex offender <br />registration law, or who violates the same require- <br />ment more than once, commits a separate con- <br />tinuing offense each time. Current law states if an <br />offender returns to the original jurisdiction, then a <br />new duty arises because the local law enforce- <br />ment agency has a renewed interest in keeping <br />him or her under surveillance. However, this <br />responsibility is not expressly written in the stat- <br />ute. AB 150 makes it clear and unambiguous that <br />a sex offender must register within a prescribed <br />period of time each time he or she enters a <br />jurisdiction.
