Victims of Crime. AB <br />976 authorizes the California Victim Compensa- <br />tion and Government Claims Board to recognize <br />an authorized representative of the victim or <br />derivative victim who represents the victim or <br />derivative victim, who shall represent the victim <br />pursuant to rules adopted by the board. Specifi- <br />cally, AB 976 amends the Government Code to <br />define "authorized representative" as an attorney, <br />the legal guardian of the victim or derivative victim, <br />a victim assistance advocate certified pursuant to <br />Penal Code Section 13835.10m, and, an immedi- <br />ate family member of the victim or derivative <br />victim who has written authorization by the victim <br />or derivative victim and is not the perpetrator of <br />the crime that gave rise to the claim. AB 976 <br />provides that, except for attorney's fees awarded <br />pursuant to law, no authorized representative shall <br />charge, demand, receive, or collect any amount <br />for his or her services. According to the author, <br />" 976 is intended to close current loopholes in <br />the existing law to ensure that victims and deriva- <br />tive victims of crime in the State of California are <br />provided with the highest quality of services, <br />assistance and protection. AB 976 passed out of <br />Senate Public Safety with technical amendments <br />on June 10, and was referred to Senate Appropria- <br />tions. AB 1263 <br />makes knowing entry or re -entry into the sterile <br />area of an airport without submitting to the screen- <br />ing and inspection of one's person and accessible <br />property in accordance with established proce- <br />dures a trespass. Specifically, AB 1263 makes a <br />knowing trespass into a sterile area of an airport a <br />misdemeanor, punishable by imprisonment in the <br />county jail not to exceed six months and by a fine <br />not to exceed $1,000, both. The bill also provides <br />that if the trespass results in the delay or cancella- <br />tion of any scheduled flight, the offense is punish- <br />able by imprisonment in the county jail not to <br />exceed one year. AB 1263 requires that the sterile <br />area of the airport be posted with a statement <br />providing reasonable notice that prosecution may <br />result from a trespass into the sterile area of an <br />airport. The League supports AB 1263 because it <br />seeks to give local law enforcement the discretion <br />to charge individuals who breech security check- <br />points at airports when trespass results in flight <br />delays and cancellations. Parole placement. <br />Existing law provides that persons released on <br />parole for specified sex offenses involving children <br />victims may not be placed or reside, for the <br />duration of parole, within 1/4 mile of a school, <br />including any or all of Kindergarten or grades 1 <br />through 6. AB 1495 specifies that the 114 mile <br />exclusion applies to public or private schools, and <br />would expand the exclusion to cover schools that <br />include 7th or 8th grade. Public Agency. Liability. <br />Immunity.
