AB 976 (Montanez). Victims of Crime. AB
976 authorizes the California Victim Compensa-
tion and Government Claims Board to recognize
an authorized representative of the victim or
derivative victim who represents the victim or
derivative victim, who shall represent the victim
pursuant to rules adopted by the board. Specifi-
cally, AB 976 amends the Government Code to
define "authorized representative" as an attorney,
the legal guardian of the victim or derivative victim,
a victim assistance advocate certified pursuant to
Penal Code Section 13835.10m, and, an immedi-
ate family member of the victim or derivative
victim who has written authorization by the victim
or derivative victim and is not the perpetrator of
the crime that gave rise to the claim. AB 976
provides that, except for attorney's fees awarded
pursuant to law, no authorized representative shall
charge, demand, receive, or collect any amount
for his or her services. According to the author,
" 976 is intended to close current loopholes in
the existing law to ensure that victims and deriva-
tive victims of crime in the State of California are
provided with the highest quality of services,
assistance and protection. AB 976 passed out of
Senate Public Safety with technical amendments
on June 10, and was referred to Senate Appropria-
tions. This bill is supported by: City of Los Ange-
les, Office of the City Attorney (Sponsor), Califor-
nia State Sheriffs' Association, California Peace
Officers' Association. Staff: Natasha Fooman,
AB 1263 (Benoit). Trespass. AB 1263
makes knowing entry or re -entry into the sterile
area of an airport without submitting to the screen-
ing and inspection of one's person and accessible
property in accordance with established proce-
dures a trespass. Specifically, AB 1263 makes a
knowing trespass into a sterile area of an airport a
misdemeanor, punishable by imprisonment in the
county jail not to exceed six months and by a fine
not to exceed $1,000, both. The bill also provides
that if the trespass results in the delay or cancella-
tion of any scheduled flight, the offense is punish-
able by imprisonment in the county jail not to
exceed one year. AB 1263 requires that the sterile
area of the airport be posted with a statement
providing reasonable notice that prosecution may
result from a trespass into the sterile area of an
airport. The League supports AB 1263 because it
seeks to give local law enforcement the discretion
to charge individuals who breech security check-
points at airports when trespass results in flight
delays and cancellations. Staff: Natasha Fooman,
AB 1495 (Chavez). Parole placement.
Existing law provides that persons released on
parole for specified sex offenses involving children
victims may not be placed or reside, for the
duration of parole, within 1/4 mile of a school,
including any or all of Kindergarten or grades 1
through 6. AB 1495 specifies that the 114 mile
exclusion applies to public or private schools, and
would expand the exclusion to cover schools that
include 7th or 8th grade. AB 1495 was passed
with amendments in Senate Public Safety on June
10, and was referred to Senate Appropriations.
This bill is supported by the California Correctional
Peace Officers Association, California Peace
Officers' Association, Californians For The Posi-
tive Enforcement of Megan's Law, Crime Victims
SB 219 (Romero.) Public Agency. Liability.
Immunity. Under existing law, a public agency
employing peace officers that adopts a written
policy on vehicular pursuits complying with spe-
cific standards is immune from liability for civil
damages for personal injury to, or the death of,
any person or damage to property resulting from
the collision of a vehicle being operated by an
actual or suspected violator of the law who is
