8.A -2 <br />The Commission's initial action was to approve a Resolution of Intention (attached), per <br />Section 41.2(a) of the Zoning Ordinance, to initiate the consideration of these <br />amendments. The Commission also considered a draft ordinance amending code <br />provisions related to child care facilities, which will be presented to the City Council as a <br />separate agenda item at a later date, due to the complexity of the issue. <br />All four of the ordinances were readily approved, with little comment, and were determined <br />to be in the public interest. All were approved unanimously (Commissioner McCoy was <br />absent), except for the amendments regarding arbors and trellises, which were approved 5 <br />to 1. Commissioner Piulle stated her objections to regulating such structures in rear yards, <br />because rear yard development was generally out of sight of neighbors. Staff noted that <br />the proposed amendment is more lenient in this regard than the current code, which does <br />not permit arbors and trellises at all in the rear yard. <br />Public comments regarding the ordinances included clarifications requested by two <br />members of the public regarding parking requirements for medical facilities and research <br />and development uses, including whether the amendments would apply to the Abbott Labs <br />proposal (they would). Most public testimony related to the amendments to child care <br />facility provisions, which are addressed as a separate agenda item on the Council's <br />agenda. <br />The Planning Commission minutes are attached to provide further background on the <br />nature of the public input and Commission discussion on the ordinances. <br />Proposed Ordinance Revisions <br />Attached are four (4) draft ordinances addressing the following issues: <br />1. The construction of arbors and trellises in setback areas; <br />2. Definitions and standards for measurement of residential height; <br />3. Definitions, land use classifications, and parking standards for medical <br />offices, medical clinics, and research and development uses; and <br />4. Definitions and allowance for "theaters" in the Central Business Retail (CBR) <br />district. <br />The May 6, 2003 Planning Commission staff report includes substantial background and a <br />summary of the key provisions for each of the four ordinances. Also attached to the <br />Commission staff report is a summary outline for each ordinance. The outline includes: <br />identification of relevant Code sections; a statement of noted problems and intended <br />purposes for the amendment; a review of how zoning regulations in other mid - Peninsula <br />cities address similar code provisions; and highlights of the key changes proposed. <br />Also provided to the Council under separate cover are redlined versions of the <br />amendments showing specific changes to the existing zoning regulations. <br />In some instances, the ordinance amendments include graphics ortables to better illustrate <br />the provisions that are proposed. These graphics are intended, for the most part, to be <br />incorporated into the Zoning Ordinance, in close proximity to the associated text. <br />
