6. A -2 <br />CBR Zone, is because there tends to be more of a proximity of getting closer to the <br />outlying areas of Downtown and residential areas. <br />5. Child Care Facilities <br />Purpose is to align the Zoning Ordinance with State law to elim pate discretionary <br />review and public hearings for family day care homes. <br />Proposed Revisions: <br />➢ Update related "child day care facility" definitions. <br />➢ Provide new Article 39 to relocate standards for child care facilities. <br />➢ Delete public notice and hearing for Large Family Child Care homes (7 -12 <br />children). <br />➢ Delete discretionary criteria for review of such child care homes. <br />➢ Modify allowable uses in zoning districts to provide consistent terminology. <br />Mr. Williams said the language that spells out the criteria for child care facilities was put <br />under Article 39 to set them apart from the definition. He said the standards stay the <br />same, but they are just in a different location within the Zoning Ordinance. <br />General Plan Conformance: <br />➢ Revisions are consistent with Plan land uses and policies. <br />Y No changes to land use or density. <br />➢ Theater use in CBR addressed in EIR and determined to be consistent. <br />Environmental Review (CEQA) <br />➢ Categorical Exemption <br />• Class 5 — "minor alterations to land use limitations ". <br />➢ No changes to land use or density (except theater). <br />➢ Theater impacts addressed in EIR. <br />Staff Recommendations <br />➢ Adopt Resolution of Intention <br />➢ Find Ordinance Amendments are in public interest. <br />Recommend approval of Amendments to City Council. <br />Chair Foust asked the Commissioners if they had any questions. <br />Commissioner Garcia asked a question regarding the proposed revisions to "allow <br />existing lower levels to be finished for habitable space." He wanted to know what kind of <br />spaces are being referred to, and could the limitation to livable space in relationship to <br />how big the lot is, conflict with each other. <br />Page 6 of 26 <br />
