6.1 A <br /> Page 11 <br /> request for continuance, and then thereafter, the applicant will have five minutes, and <br /> then Council discussion. <br /> The appellant, Mr. Marc Warsowe, withdrew his request for a continuance. Mayor lra <br /> continued with the appeal process with the staff presentation next and to be followed by <br /> not more than 15 minutes each for the applicant and the appellant to present their <br /> arguments, and followed by Council discussion. <br /> A Council Member requested clarification from Ms. Thompson, the City Attorney, on the <br /> withdrawal of the continuance. Ms. Thompson clarified that this withdrawal was <br /> acceptable, on the record, and that the applicant can reserve up to five minutes for a <br /> response. She reminded the appellant and applicant, that this venue is not a court of <br /> law and that Council is listening to a review of the Zoning Administrator's decision and <br /> making a determination of whether or not he followed the code. <br /> Mr. Warsome stated that he had withdrawn his request for a continuation in writing. <br /> Mayor Ira acknowledged the statement and opened the public hearing. <br /> Mr. Blake Lyon, Senior Planner, provided a general framework of the analysis and <br /> information available (presentation on file). He asked Council to uphold the decision as <br /> rendered and expressed confidence that the decision, from a zoning administrator <br /> viewpoint, was appropriate and responsive to zoning ordinance. <br /> Mayor Ira opened the public hearing. <br /> Mr. Warsowe, the appellant, explained in detail why he chose not to request the <br /> continuance and his dissatisfaction. He spoke about the various impacts, the issues he <br /> and others objected to, and he opined that their concerns and objections were not <br /> satisfactorily addressed by the City. He opined that the process lacked vision, balance, <br /> notification and appropriate representation of all the neighbors. He noted that he <br /> submitted additional materials. <br /> Mr. Robert Carroll, the applicant, noted that his fianc�e, an arborist, an architect and <br /> friends, were present in the audience and he asked Council to deny the appeal by Mr. <br /> Warsowe. He said he is also here to appeal one of the conditions of the NOA (notice of <br /> official action). He provided some personal background information. He spoke about <br /> what he has specifically done to comply with the rules. He also spoke about impacts to <br /> him if there are any further delays and he asked the Mayor and Council to deny the <br /> appeal and notice of action. He asked the City Attorney if he could appeal one <br /> condition on the NOA. <br /> Through the Chair, City Attorney Thompson stated that the time for an appeal was the <br /> same as for Mr. Warsowe. <br /> Mr. Warsowe spoke about the roof proposed by Mr. Carroll and the Zoning code as <br /> being different and his alternate proposal that he said Mr. Carroll had rejected.
