• <br /> 410 4 <br /> (d) Notice of Appeal. Upon filing a request for an appeal, <br /> the City Clerk shall give written notice of such appeal to the <br /> officer or employee of the City, or the Planning Commission, as <br /> the case may be, whose determination, decision, or action is being <br /> appealed, and shall notify such officer, employee or the Commission <br /> of the time and place of the hearing thereon. The City Clerk <br /> shall, in every case, notify the Planning Department of such appeal <br /> upon receipt of a request therefor. <br /> (e) Public Hearing . A public hearing shall be held upon <br /> the appeal. Notice of such public hearing shall be given, to the <br /> extent not inconsistent herewith, in accordance with the provisions <br /> of Article 49 of the Zoning Ordinance. <br /> (f) Action on Appeal. The Planning Commission, or the City <br /> Council, as the case may be, may affirm, reverse or modify the <br /> decision, determination, or action being appealed as it deems <br /> just and equitable. The Council may, pending final determination <br /> of any appeal, require the Planning Commission or any administra- <br /> tive official to submit its or his recommendations to the Council. <br /> The determination on an appeal by the City Council shall be final. <br /> 16 . INTERPRETATION. The provisions of this resolution shall <br /> be interpreted, administered, and implemented consistent with the <br /> provisions of the Environmental Quality Act of 1970 and the guide- <br /> lines. <br /> 17 . RESCISSION. Resolution No. 6865, entitled "Resolution <br /> Establishing Procedures and Guidelines for Preparation and Use <br /> of Environmental Impact Reports, " adopted February 5, 1973, is <br /> hereby rescinded. <br /> 18. SEVERABILITY. The paragraphs, subparagraphs, sentences, <br /> clauses and phrases of this resolution are hereby declared sever- <br /> able, and if any paragraph, subparagraph, sentence, clause, or <br /> -24- <br />
