r <br />CHAPTER 9 <br />Sections with respect to the authorization of revenue bonds for such <br />yub <br />(contd.) project be abandoned, in which event the council shall either <br />(i) by resolution terminate the proceedings with respect to such <br />project or (11) by resolution adopted by the affirmative votes <br />of 4/5 of all its members determine to proceed and authorize <br />revenue bonds pursuant to said Revenue Bond Law of 1941 (includ- <br />ing compliance with the provisions of said Law relating to revenue <br />bond elections and compliance with sections 903, 904 and 905 hereof). <br />CHAPTER 10 CHAPTER 10 <br />Sections <br />SPECIAL ASSESSMENTS AND BONDS <br />1001 General. The council may acquire or construct any <br />improvement within or for any district or- improvement district <br />and assess the costs thereof and the expenses incidental there- <br />to upon the lands benefited thereby. <br />1002 Reclamation. The costs of reclamation of lands shall <br />be borne solely by the lands reclaimed. <br />1003 Reference. The provisions of Chapters 1 2 3, 5 and 11 <br />of this ordinance shall apply to such proceedings, and, to <br />the extent applicable, shall be controlling, excepting as <br />herein otherwise provided. <br />1004 Procedure. The Municipal Improvement Act of 1913 being <br />Division 12 of the Streets and Highways Code, excepting, however <br />Sections 10606 to 10608, inclusive, of the Streets and Highways <br />Code, shall apply except as otherwise provided in sections 1003 <br />and 1013 hereof. <br />1005 Necessity. Pursuant to Section 17 of Article XIII of the <br />California Constitution, the council may take proceedings to <br />determine that the public interest, convenience and necessity <br />require such acquisitions or improvements and that Division 4 <br />of the Streets and Highways Code shall not apply. In such <br />event, the provisions of this chapter shall apply. <br />33 <br />
