advertising for bids. To allow Railroad to incorporate them in its plans and specifications, City <br /> will provide JPB with its forms of Construction Permit for the project prior to bid. City agrees to <br /> issue Construction Permit to Contractor after contract award in the form provided prior to bid. <br /> The form of Construction Permit will contain reasonable conditions and restrictions including <br /> specifying normal work hours Monday- Friday 8AM- 8 PM, but allowing night and weekend <br /> work for railroad- related work that cannot be safely or practically done at other times. City will <br /> issue a Haul Route Permit, if required, for routes along City streets between work areas and State <br /> highways. The JPB will provide for construction staging and traffic control in its final bid <br /> documents. <br /> 7. Quality of Work. All work contemplated in this Agreement shall be performed <br /> in a good and worker -like manner in accordance with the plans and specifications to the <br /> satisfaction of the parties, and each portion shall be promptly commenced by the party obligated <br /> to do the same and thereafter diligently prosecuted to completion in its logical order and <br /> sequence. <br /> 8. Maintenance. Upon completion of construction, the parties shall be responsible <br /> to maintain the following Improvements (except, in the case of the City, as otherwise set forth by <br /> City code, ordinance, regulation or statute): <br /> a. City shall maintain and maintain at its expense (including electric power for <br /> lighting): <br /> i. City streets and pavement up to the crossing panels (the ground <br /> markers that demarcate the Railroad right -of -way) but not between the crossing panels, street <br /> curbs, gutters, medians, sidewalks within its easement area, as well as pavement markings and <br /> 6 <br />
