CWM:djm 11/06/89 (098/#25) <br /> CWM:djm './29/89R <br /> <br />Section 21081.6 of the Public Resources Code. Authority for <br />reporting specific elements of the program shall be assigned on a <br />site specific project basis. For each of the significant <br />environmental effects identified in the EIR, the City Council and <br />the Agency find as follows and have determined the following <br />facts to support each finding: <br /> <br /> 1. LAND USE. <br /> <br /> a. Significant Effects. General Plan Buildout of the <br /> <br /> Amendment Area would be encouraged by the Second <br /> Amendment and could result in "land use succession", <br /> which is the tendency for small and economically <br /> marginal land uses to be replaced with larger, more <br /> intensive uses in response to strong economic trends. <br /> This could result in conversion or redevelopment of <br /> non-conforming housing units and small scale <br /> commercial buildings in transition areas with larger <br /> conforming commercial buildings. <br /> <br /> b. Findings. This land use succession impact cannot <br /> occur as the result of commercial development in <br /> areas zoned for residential use, as to permit such <br /> development would be in violation of state and local <br /> <br /> zoning laws. Development of districts other than <br /> residentially zoned districts would enhance the <br /> character of the Downtown Area even if it would <br /> <br /> result in some replacement of marginal land uses. <br /> These impacts could be reduced by encouraging only <br /> larger scale uses where they are permitted by the <br /> <br /> 4 <br /> <br /> <br />
