Dodge <br /> City Clerk <br /> Minutes of the Regular Adjourned Meeting <br /> REDWOOD CITY COUNCIL <br /> August 8, 1955 - 8:00 P. M. <br /> Devotional was led by Reverend Wilbur Westerdahl, Pastor of the Peninsula Covenant <br /> Church. <br /> ON ROLL CALL the following were noted present: Councilmen Floyd D. Granger, Paul <br /> Jones, William H. Royer, Robert V. Spillers, Mayor Sidney D. Herkner and City <br /> Clerk R. S. Dodge. Noted absent were Councilman Carl A. Britsch g i and Council. - <br /> man Hiram S. Stout who w as reported ill. Also present were City Manager <br /> E. A. Rolison, City Attorney C. B. Currie, City Engineer Glenn M. Jain, Water <br /> Superintendent H. L. Winter, Building Inspector S. H. Kreiss, Assistant Fire <br /> Chief Willis Leslie, Administrative Assistant Orrin Wendling, City Collector <br /> Paul E. Perrin, Police Chief Stanley Wood, Police Captain William Faulstich <br /> and Ted Thompson, President of the Chamber of Commerce. <br /> REPORT FROM THE CITY MANAGE? REGARDING UPHOLSTERING BUSYNESS AT 130 CERRITO AVENUE. <br /> Residential Area. In his report the City Manager stated that he found that <br /> this business, which is sometimes referred to as "occupational" existed at the <br /> time this area was annexed to the City in 1953, and therefore has been permit- <br /> ted to operate on a basis of non - conforming use, without the necessity of <br /> securing a Use Permit from the Planning Commission. <br /> It was his opinion that this business should be rated as "commercial" rather <br /> than "occupational" due to the advertisement carried in the classified section <br /> of the Telpphone Directory, and the volume of business which is apparently <br /> being conducted. He recommended that the City Collector be instructed to col- <br /> lect the usual license fee of 03.00 per quarter as provided in our Business <br /> License Ordinance No. 447, for this type of business. <br /> Councilman Spillers moved acceptance of the City Manager's report, seconded by <br /> Councilman Royer. Mrs. Vera Eskin spoke in regard to use of home occupation <br /> and the moving of Gilbert's business from 2510 El Camino Real to 130 Cerrito <br /> Avenue in 1951. After much discussion, it was the concensus of opinion that <br /> this should be turned over to the District Attorney's office for their recommen- <br /> dation. <br /> Councilman Jones was of the opinion that the Council did not have the power <br /> under the ordinance to grant a non - conforming use in an R -3 District, and <br /> that they would be condoning the violation if they collected a business <br /> license. He felt that the Gilbert's should be given reasonable time to close <br /> I/ <br /> their business. <br /> In answer to whether back taxes and licenses could be collected, City Attorney <br /> Currie stated that escaped assessments could be picked up and a tax bill pre- <br /> pared based on March 1st valuation. Councilman Granger stated that he was voting <br /> on the basis that he is not an attorney and thus he could not make a decision <br /> regarding the issue.
