414 <br /> PLANNING COMMISSION LETTER RE R. KILBORN REQUEST TO REZONE LOTS 14 AND 15, W. W. & M. FROM <br /> R -2 TO R -3. REFERRED BACK TO COMMISSION BY CITY COUNCIL. The Planning Commission ad- <br /> vised that they are unable to assist the applicant in working out his problem. <br /> Councilman Royer commented on the fact that the people in the area apparently did not <br /> object to the building of three dwellings on two lots but did object to Mr. Kilborn's <br /> request to rezone the area from R -2 to R -3. Councilman Jones moved that the matter <br /> be referred tothe City Attorney to check into and report back at the meeting of <br /> Aug.zst 29, seconded by Councilman Stout and carried. <br /> BAY BRIDGE SALES CO. APPLICATION FOR PERMIT TO OPERATE NEW AND USED MERCHANDISE STORE AT <br /> 2001 BAYSHORE. The applicant has deposited 450.00 to cover the license fee for one <br /> year. The new organization will replace the firm of Inter - Island Trading Company <br /> who operated in the same location. Councilman Granger questioned the fee of 450.00 <br /> as compared with the 4100.00 license deposit which is required of all retail types <br /> of business. City Attorney explained that this $100.00 deposit was a six -month <br /> guarantee andw as returned to the retailer at the expiration of the six -month period, <br /> whereas, the $50.00 deposited by the Bay Bridge Sales Co. was a license fee retained <br /> by the City. This request for a permit is in accord with "new and used merchandise " <br /> ordinance. City Attorney was requested to report on this matter at the next meeting. <br /> Councilman moved approval of the application for license, subject to the <br /> proper fee, seconded by Councilman Royer and carried. <br /> MISS DOROTHY ROBERTS presented First Place Trophy #30 won by the "Stars. of Tomorrow" at the <br /> recent Alameda County Fair at Pleasanton. Mr. Dave Schutz of the Tribune accepted <br /> the trophy for the Recreation Commission. <br /> W. d. SPROUL PROPOSED RESOLUTION -TIDE GATES TRUCTURE. Mr. Sproul'sproposal was to <br /> appoint him as Superintendent of Construction under the City Engineer's supervision, <br /> to have full charge of the construction work such as buying materials, selecting and <br /> hiring men and machines, and the installation of the pumping system. He guaranteed <br /> finish o f the work within 100 days from the date of acceptance of his proposition <br /> subject to penalty of 25% should he fail to complete the job within the specified <br /> time. He agreed to do all of this work for the sum of 440.00 per day for 100 days. <br /> Mr. Sproul addressed the Council presenting details of his proposed offer claiming <br /> that he would be able to save the City some 440,000 if his plan were accepted. <br /> Councilman Britschgi questioned the legality of the proposal explaining that the <br /> City's operations were governed by Charter and by State Codes. Councilman Brits - <br /> chgi complimented Mr. Sproul on his interest in the matter but called attention to <br /> the fact that the City has an Engineering Department which has responsibility of <br /> preparing plans and specifications for such engineering programs. He suggested that <br /> Mr. Sproul's proposal, including any drawings or information, be turned over to the <br /> City Engineer. <br /> BIDS ON BONDS. Mr. Ernest Wilson reported back that he had checked the bids and found the <br /> bid of Gross, Roger & Co., as noted above, was the best bid and he recommended award <br /> to that firm.. Councilman Royer offered Resolution No. 1916 awarding contract to <br /> Gross, Rogers & Co. and moved adoption, seconded by Councilman Jones, carried on roll <br /> call, Councilman Spillers noted absent. Councilman Britschgi then moved that all <br /> other bids be denied and the certified checks be returned to the unsuccessful bidders, <br /> motion seconded by Councilman Jones and carried. <br />
