The Clerk explained that this <br /> had been held up before because of the deed. Councilman Jones moved that the Planning <br /> Commission's recommendation be approved and the Clerk be authorized to accept the deed, <br /> seconded by Councilman Royer and carried. <br /> II PLANNING COMMISSION RECOMMEND - RD ALLOWANCE OF VARIANCE TO CLARENCE I. PULLIAM, 3527 Jefferson, <br /> FOR 1' 10" SIDE YARD FOR GARAGE. Planning Commissioner Greenwold stated that this is <br /> one of the homes effected by the widening of Jefferson Avenue. This was followed by a <br /> short discussion after which Councilman Royer offered RESOLJTION 1940 FOR A VARIANCE TO <br /> CLARENCE I. PtLLIAM FOR 1' 10" SIDE YARD FOR GARAGE and moved its adoption, seconded by <br /> II Councilman Stout and carried on roll call, Councilmen Britschgi and Spillers being noted <br /> absent, <br /> PLANNING COMMISSION RECOMMENDED APPROVAL OF APPLICATION FOR RESUBDIVISION OF PORTION OF LOT <br /> 16, BLOCK 8, FRIENDLY ACRES, (3450 Page Street) OWNER TO PAY FOR SEWER LATERAL. City <br /> Engineer Jain stated that resubdivision should be subject to the applicant being able to <br /> connect to the sewer and paying for the sewer lateral. Councilman Royer moved approval <br /> of the Planning Commission recommendation subject to the applicant being physically able <br /> to connect to the sewer and pay for the work, seconded by Councilman Granger and carried. <br /> PLANNING COMMISSION RECOMMENDED APPROVAL OF B. R. JONES APPLICATION TO RESUB VIDE <br /> DI LOTS 2 5 & <br /> 26, ROUSSEL SUBDIVISION (158 Central Avenue) INTO 3 LOTS WITH 25 FOOT SETBACK, OWNER TO <br /> PAY FOR SEWER LATERALS. Councilman Stout moved approval of the Planning Commission's <br /> recommendation, seconded by Councilman Granger and carried. <br /> PLANNING COMMISSION RECOMMENDED APPROVAL OF ALLEN BROS. APPLICATION FOR VARIANCE, 10' REAR <br /> YARD, 9' WIDE GARAGE AND TIE 2 LOTS INTO SINGLE BUILDING SITE (335 Oak Avenue). Mrs. <br /> Davis, resident of Redwood Avenue and adjoining property owner, object to this variance. <br /> She stated that if this was allowed, she and some of her neighbors would ask for the same <br /> setback priviledges. She further stated that this variance had been turned down once <br /> before by the Planning Commission. <br /> City Attorney stated that the property in the rear is owned by the same property owner <br /> and thus there is more than the 15' setback that is required. Planning Commissioner <br /> Greenwold stated that the garage had been widened from 8' to 9' and they have taken out <br /> one of the proposed units. Mr. William Allen, contractor and owner, stated that the <br /> entrance would be on Oak Avenue and not Redwood Avenue as stated by !qrs. Davis. He further <br /> stated that this was in an R -3 district and he bought this property in good faith. <br /> Councilman Stout moved denial of the application. This was followed by discussion in <br /> regard to the court trial and the findings and recommendations of the Judge. Councilman <br /> Jones asked that Councilman Stout amend his motion and hold this matter over one week <br /> for study, Councilman Stout so moved, seconded by Councilman Jones and carried. <br /> RECOMMENDATIONS AND SUGGESTIONS, COUNCIL MEMBERS AND DEPARTMENT HEADS: <br /> II Councilman Stout moved that the matter of park benches be placed on the agenda for one week, <br /> City Clerk to bring the correspondence regarding the clubs interested in contributing to <br /> the cost of the concrete benches, seconded by Councilman Jones and carried. <br /> Councilman Stout stated that the Park and Recreation Commission sent in their recommendation <br /> as to the location of benches in the parks. Councilman Granger stated that the benches in <br /> the parks were being made by the Park Department. The Clerk reported that the Clubs <br /> willing to contribute to the cost of the benches had asked that they be given permission <br />
