Lebsack, Esq., Assistant City Attorney., Councilman Granger asked <br /> that. this letter be made a part of the record. <br /> "Re: Bids for Mining Lease <br /> Stulsaft Park <br /> Dear Mr. Lebsack: <br /> I have before. me your letter of November 8th, in which you <br /> state it is the opinion_.of your..office that the Redwood City <br /> Council_. leg. ally. had..authority to. ahove- indicated <br /> mining lease.in.the.manner..inwhich i.t..did, to A. F. Oddstad, <br /> Jr. <br /> Perhaps I do not. clearly understand the terms and conditions <br /> under which the.ward. was made., and as you. make no comment on <br /> the questions raised __in. our . telegram of November 4th, in which <br /> we ask three, questions as to whether you we.re•not in violation <br /> of the provisions of your•Charter, the provisions of the State <br /> Municipal Code, as well.. as in violation._of..the.well establish- <br /> ed laws_ relating. to. b ids, I :w.onder if .you. would not have the <br /> patience to _explain.. to. me, the authority. possessed by the City <br /> Council .which supe.rse: des. well. defined regulations and long <br /> established law. <br /> In the absence of.,. further comment from..your office, I will <br /> continua to believe that, the illegality and inequity of the <br /> last minute procedure of . the Council in.making the award to <br /> A. F. Oddstad, Jr., is_p.erfectly clear. and in extreme bad <br /> faith and a fraud against our Company and.the other bidders. <br /> Henc.e., on the record as known to us, we can. do no less than <br /> to accomplish a_judicial review of the Council's action in <br /> this matter. <br /> I might add that we have.receiv.ed several communications from <br /> residents. of R.edwoo.d..Ci.ty, who are highly. critical of the <br /> Council's action. Among_.other comments we.have received, on <br /> which particularly disturbs me is to the effect that both you <br /> and Mr. Currie are said to be on the Oddstad payroll and have <br /> for a long time represented him and certain of his corporations. <br /> • <br /> If that representation is so, it raises many questions, for <br /> such a dozy arrangement can hardly be justified unless everyone <br /> concerned. subscribes to. what might appear to be the present <br /> Republican dome, first publicly. enunciated.. by Secretary Wilson, <br /> that, "What is, good for. Oddstad is .good. f.or Redwood City ". <br /> In any event, it would, appear that this. whole. _matter should not <br /> only be subject to a.judiciai rev.i.ew..- which we shall seek <br /> at an appropriate .time._- but that some manner of public hearing - <br /> would be desirable.in the .public interest. <br /> Very truly yours, <br /> • <br /> G. Nugent atated that he <br /> had received .several_ communications from residents of Redwood City, who were highly <br /> • <br /> critical of the Council's action. Councilman .Granger was of the opinion that any citizens <br /> who did not agree with the Council's action should notify the Council of their objections <br /> and not complain to the Indian•Monument .Corporati.on. Under the circumstances of the so <br /> called complaints, Councilman Granger chose to ignore them as such. City Attorney Currie <br /> stated he had answered Mr. G. A. Nugent's letter, and he wanted it understood that his <br /> office, at no time, has acted as attorney for Mr. A. F. Oddstad Jr. in any matter con- <br /> nected with the City of Redwood City. This was followed by general discussion. <br /> R. L. WALKER REQUEST RECONSIDERATION REQUEST. TO MOVE BUILDING TO. CORNER SPRUCE AND SHASTA. <br /> The Clerk. read the letter wherein Mr. Walker appealed_for. re.considerat.ion. of the Council's 1 <br /> action in regard .to moving. of a building from .Santa_ Clara to Redwood City. This building <br /> is . in.e xcellent .condition. and .is to be used. solely for. an..office to. govern the sale of <br /> red cedar shingles.. and .shakes.. Tt will conform.to all requirements of the Fire, Building <br /> and Health Deaprtments by the addition of sanitary facilities and a fire resistant siding <br /> such as composition or asbestos shingles. The Clerk stated that last week's agenda <br /> showed the building was being moved from San Carlos. This was in error, it should have <br />
