Councilman Britschgi's motion lost with <br /> Councilmen Jones, Spillers, Stout and Mayor Herkner voting NO. <br /> Councilman Stout moved that the permit be granted to move the building from Santa <br /> Clara to Mr. Walker's. lot on the corner of Spruce and shasta Streets based on the <br /> condition that the. building .be.madeto conform to Fire Zone No. 2 regulations and that <br /> it meet the sanitary and health reguirements, seconded. by. Councilman Spillers. <br /> Councilman Britschgi.again...stated that .he was. against allowing. a small building to be <br /> built on Spruce. Street as he was of the opinion that it would spoil the looks - of the <br /> street in the event that it becomes a major city.stree.t... This.was_followed by discuss- <br /> ion as to what measure the City could stop or allow a limited time for the building <br /> to exist at the proposed location.. City Attorney stated that this could not be done. <br /> Councilman Britschgi then made a substitute motion that, the Council tale under con- <br /> . <br /> sideration.the matter of.making this area into Fire Zone .#1, seconded by Councilman <br /> Granger. This was followed.by a heated..discuss. ion. r'i.re Chief. Lodi. suggested that <br /> this be given considerable thought as it would require that all the buildings in the <br /> area would be required to build for hour fire resistant buildings. Councilman Stout <br /> was of the opinion that this had nothing to do with his motion and he asked the Mayor <br /> to rule on the question. Councilman Granger withdrew his second and Councilman <br /> Britschgi withdrew his motion. .councilman Stout's motion carried with Councilmen <br /> Britschgi, Granger and Hoyer voting NO. <br /> Councilman Britschi mo.ved that consideration be given to rezoning the area of Spruce <br /> Street from El Camino Real to the railroad tracks to Fire Zone No. 1, seconded by <br /> Councilman Granger. . Councilman Stout was of the opinion. that this. should be done after <br /> 1 <br /> the Council knows for sure .if..Spruce. Street will become a major..city street. Motion <br /> carried. <br /> • FURTHER CONSIDERATION PLANNING COMMISSION DENIAL A PPLICATIO OF V. MASIRE TO RESUBDIVIDE LOTS <br /> • 5, 6, 7 and 8, BLOCK 4, WEST REDWOOD ( 1701 Rossevelt Avenue ). The City Clerk stated <br /> that he had been notified by. the Planning Commission. that they. still .did not approve the <br /> resubdivision. Mr. Masaire stated that there were no protests at the time of the public <br /> hearing held by the Planning Commission.. Clerk Dodge. stated that the.Planning Commiss- <br /> ion was of the opinion that only single family units should be allowed. on this partic- <br /> ular piece of property if subdivided. This was followed by discussion in regard to <br /> building 37.' lots. Mr. Masaire stated that there was total of 87 *' which would allow <br /> him to build on two 432' lots. The lots would be 43.9' x 104'. <br />
