292
matter be continued and referred back to the Planning Commission for possible R -3 zon-
ing, seconded by Councilman Spillers. Councilman Stout suggested that the matter be
referred to the Real Estate Committee. City Attorney Currie suggested that the entire
matter be continued until the Planning Commission is heard from. Motion carried on roll
call, Councilman Granger voting NO.
MR. PHOENIX APPEARED BEFORE THE COUNCIL WITH A MAP CONCERNING THE EXTENSION OF EBENER STREET,
1
reviewing past Council meetings when this matter was discussed, and informed the Council
that Mr. L. A. Thatcher, owner of the large strip of land through which Geneva and Lucern
would extend is now against the opening of either street. There was much discussion re-
garding the acquisition and moving of the house on Lucern after which Councilman Stout
moved that the matter be referred to the City Engineer and City Attorney for report back.
This motion was lost for lack of a second. Councilman Spillers suggested that the people
be given a choice, either open Lucern or Geneva, and proceed with condemnation proceedings.
Mr. Kupfer had visited the home of Mr. & Mrs. Thatcher with house movers for appraisal and
the movers advised him that it would cost approximately $450.00 to move the house, but they
did not believe that the City Inspectors would issue the necessary permit. Mr. Phoenix
suggested that the original improvements be accepted, so that the street work can be com-
menced, and then later continue the matter of opening Ebener to Woodside Road or to Hess
Road through Lucern. Fire Chief Lodi objected to the cul -de -sac at the end of Ebener as
it would exceed the 250 feet requirement. Councilman Royer moved that the City Engineer
prepare plans for assessment district through Lucern, seconded by Councilman Britschgi.
City Attorney advised the Council that the plans for assessment district describing the
work and improvement must be prepared and the proceedings started before condemnation pro -
ceedures can be started. City Engineer doubted whether the work could be completed this
year. Motion carried.
MR. RUSS DENNY APPEARED BEFORE THE COUNCIL APPEALING FOR FINAL INSPECTION WHICH WILL CLEAR
UTILITIES IN HIW NEW SHOW ROOM ON THE CORNER OF MAIN AND ELM STREETS WHICH IS NOW COM-
PLETED. He informed the Council that the City Engineer notified him that sidewalk must
be completed to Lathrop Street, acording to the Ordinance covering sidewalks. He wishes
to pour sidewalk only on that portion of Main and Elm fronting the new building. Engineer
Jain informed the Council that when Mr. Denny's original building was completed the side-
walks were in a hazardous condition and Mr. Denny received a notice to repair the sidewalk.
Since it was not done at that time, it should be done now according to the Ordinance.
After discussion as to whether or not it is practical to erect a sidewalk at that loca-
tion at this time, Councilman Granger moved that Mr. Denny be allowed to construct a side-
walk in the front of his show room, and that he be given inspection clearance by the In-
spector. At some future date, if required, he will continue the sidewalk to Lathrop St.
Mr. Denny will take steps to eliminate the hazardous condition of the old sidewalk on Elm
Street. Motion carried.
MRS. DOROTHY ROBERTS ADDRESSED THE COUNCIL PRESENTING A TROPHY WON BY THE STARS OF TOMORROW II
IN SAN FRANCISCO DURING THE ST. PATRICK'S DAY PARADE. This is the twenty- fourth con-
secutive First Place cup won by the Stars of Tomorrow. Councilman Spillers accepted the
cup for the Recreation Commission.
MAYOR HEHKNER INFORMED THAT DURING THE LAST WEEK CINNABAR ORE WAS DISCOVERED IN THE FARM HILLS
AREA. This has been checked by geologists and there is indication that the ore, from which
