In answer to Mr. Kohnets question as to how long <br /> before he would be given the information, Mr. Jain indicated that he would do everything <br /> possible to expedite this program. He was still requesting only that he be allowed to <br /> complete the sewer and water plans before working on the widening program. Councilman <br /> II Royer suggested that the property owners be asked to circulate a petition for improvements. <br /> If this is done the Council will do everything possible to complete the entire project. <br /> Councilman Spillers stated that any delay in this program would result in holding up the <br /> future of the area. He insisted plan lines should be set immediately and that if necessary <br /> outside engineering should be provided at the City's expense. Councilman Granger suggested <br /> the possibility of Canyon Road being declared an arterial and perhaps be eligible for gas <br /> tax money. After further discussion, motion to grant resubdivision conditioned upon Mr. <br /> Jain furnishing information as to the amount of land to be deeded by Mr. Kohne was carried <br /> unanimously on roll call. Councilman Granger moved that the Engineering Department take <br /> steps in an effort to have the Canyon Road declared a Major City Street and thus be elig- <br /> ible for gas tax funds. The motion was seconded by Councilman Spillers. City Engineer <br /> advised that it would be necessary for the Council to pass a resolution declaring Canyon <br /> Road a major street after which the State will be requested to approve and allow a paving <br /> project. Councilman Granger's motion was changed to instruct the City Attorney to being in <br /> a resolution at the meeting of January 24th, approved by Councilman Spillers and carried. <br /> CITY ENGINEER REGARDING PLANNING COMMISSION GRANTING USE PERMIT TO J. H. DUKE TO CONSTRUCT HOME <br /> ON 700 BLOCK OF CANYON ROAD. Mr. Jain does not feel that this use permit should have been <br /> granted at this time as his department is not in a position to determine the assessment <br /> against his property for sewer and water system in the Canyon Road area until complete <br /> plans, estimates of cost and preliminary assessments have been determined for the entire <br /> area. Mr. Jain also feels that permission to tie into the existing sewer in Breeze Place <br /> at the rear of Mr. Duke's property should not be allowed, due to the fact that his exper- <br /> ience has been that the granting of permission to connect to adjacent sewers has resulted <br /> in holding property owner to future conditions difficult to enforce. Such conditions can- <br /> not be made of record and become an obligation on the part of future owner in case of sale <br /> or transfer of property. Mr. Duke and Mr. Don McKay addressed the Council, stating that <br /> the lot in the 700 block of Canyon Road had been purchased recently. In applying to the <br /> County for a permit to build just prior to the annexation to Redwood City he was told that <br /> permit would be granted if he would get sewer and water services. Mr. Duke was anxious to <br /> start building and if allowed to tie into the sewer at Breeze Place would be willing to <br /> sign an agreement to pay his share of any necessary assessment. He has also approached <br /> his neighbor and purchased an additional 5' of property which would allow him a 25' set- <br /> back from the present property line. Mr. Jain stated that it would be impossible at this <br /> II time to indicate the amount of property necessary for the future widening of Canyon Road. <br /> He stated that he would like to see the City purchase Mr. Duke's lot so that Breeze Place <br /> and Bain Place, now dead - ended, could be cut through to Canyon Road. If this is done at a <br /> future date, it will be necessary to purchase any buildings on the lot. Councilman Spil- <br /> lers stated this is another case where plan lines should be set. Councilman Stout stated <br /> that in his opinion there was no alternative other than delay until such time as the City <br /> Engineer could indicate the width and grade of Canyon Road.
