He then moved that the City <br /> and County Planning Commission be contacted and advised of the Council's thought in this <br /> matter. Mrs. Vera Askin stated that the County Planning Commission already had this mat- <br /> ter under consideration. Seconded by Councilman Britschgi and carried. <br /> INTRODUCE ORDINANCE REZONE AD -APT CORP. PROPERTY ON CHARTER STREET FROM R -3 TO R -4 FIRE ZONE #2. II <br /> City Attorney Currie stated ordinance was ready for introduction as regards the rezoning, <br /> the Fire Zone restriction to be covered by a separate ordinance. Councilman Royer moved <br /> introduction of ordinance, seconded by Councilman Spillers. In the comments that followed <br /> it developed that this rezoning and fire zone #2 restriction will act as a.buffer between <br /> the commercial and residential area. Motion carried. <br /> FURTHER CONSIDERATION RICHARD KOHNE TO RESUBDIVIDE A PORTION OF LOT 6, BLOCK 24, OAK KNOLL <br /> MANOR (Canyon Road), held over from December 20, 1954 meeting. This item was considered <br /> at a recent study meeting at which time a 40' pavement with 60' right -of -way was decided <br /> upon. City Engineer Jain requested the withholding of action on Mr. Kohne's application <br /> pending the time when the grade, and the amount of property needed for widening to the 60' <br /> width w <br /> i as well as sufficient property to allow proper slope on the cut of the bank. He <br /> called attention to the fact that dedication of 10' did not mean too much inasmuch as it <br /> is impossible at this time to establish the amount of property necessary to take care of <br /> the slope. He stated further that his department was attempting to equalize both sides <br /> of the street and he strongly urged that the area be held up until decision is reached. <br /> Mr. Kohne stated he was willing to give the necessary slope easement in addition to the <br /> 10' already promised. Mr. Jain still insisted that the amount of property is an unknown <br /> fact. In answer to a question from Councilman Royer it was determined that outside En- <br /> gineers are now conducting the necessary studies to the end that sewer and water lines <br /> will be established throughout this area. It will be some months before these facilities <br /> are available.to the property owners. City Engineer Jain then sketched the problem on <br /> the black -board which indicated the fact that it would be impossible at this time to det- <br /> ermine the amount of property necessary for street widening. Mr. Kohne advised that his <br /> purpose in requesting permission to subdivide was to assure him that future assessments <br /> would be divided between two lots rather than one bond against the entire piece and the <br /> resultant difficulty and expense in requesting a split in the 'bond in the event that one <br /> lot be sold. Councilman Britschgi called attention to the Council's tentative decision to <br /> provide a 40' pavement and 60' right -of -way and he requested information from the City <br /> Engineer as to whether or not an immediate survey could be conducted toward laying out a <br /> street along these lines. City Engineer Jain advised that his department had been work- <br /> ing deligently in plotting the location of the sewer and water lines. He stated he would <br /> like to have sufficient time to develop all necessary information covering the entire area. <br /> Councilman Royer was advised that there is an assessment under way at the present time for <br /> sewer and water facilities but that no petition had been circulated for street improvements. <br /> Councilman Royer then suggested the possibility of granting_the resubdivision subject to <br /> City Engineers final decision. After further discussion, Councilman Jones moved that Mr. <br /> Kohne be allowed to subdivide his property subject to deed being furnished the City for <br /> necessary land required to widen the right -of -way to 60', seconded by Councilman Royer. <br /> Councilman Britschgi suggested that the Engineer proceed with the tentative plans for the <br />
