Motion carried. <br /> COUNCILMAN ROYER ENTERED THE MEETING AT 8:39 P. M. <br /> II REAL ESTATE COMMITTEE RE: PROPOSED PURCHASE SIFERS PROPERTY ADJOINING COMMUNITY PARK. Council- <br /> man Royer stated that the committee appraised the property and they feel that the property <br /> is worth $1,900.00, but it is up to the City Council to decide if they wish to purchase the <br /> property. At the Council meeting of May 9, 1 955 the Council approved the acquisition of <br /> Lots 34. and 35, Block 4, Jefferson Acres, and transferred $1,900.00 for the purchase if the <br /> Real Estate Committee felt it was a reasonable figure. Councilman Jones moved that the <br /> Real Estate Committee report be accepted, seconded by Councilman Spillers and carried. <br /> This property is adjacent to Community Park. Councilman Granger questioned the purpose <br /> of the purchase of the property and was informed that it will be valuable property for off - <br /> street parking near the War Memorial building. Councilman Royer stated that the lot would <br /> be valuable to the City in conjunction with the War Memorial building and the Park. Coun- <br /> cilman Spillers moved that the City Clerk be authorized to accept the deed to this property <br /> for an amount not to exceed $1,900.00 plus the closing costs, seconded by Councilman Stout <br /> and carried. <br /> COUNCILMAN BRITSCHGI ENTERED THE MEETING AT 8 :45 P. M. <br /> PERSONAL APPEARANCE. HENRY McGARVEY RE: PROPOSED WIDENING SPRUCE STREET. A CONDITION SET BY <br /> PLANNING COMMISSION WHEN ISSUING USE PERMIT TO TRUSTY & KREISS FOR PERMIT TO OPERATE STOR- <br /> AGE YARD AT SHASTA AND SPRUCE. Mr. Bond, representing Mr. McGarvey, appeared before the <br /> Council stating that this matter involves the issuance of a use permit to Trusty & Kreiss <br /> to continue a business of making redwood shakes. One of the contingencies of issuing a <br /> Use Permit is that the property owner deed 10 feet of the property along Spruce Street for <br /> the purpose of widening Spruce Street. The property owners feel that the deeding should <br /> not be completed until such time as the widening takes place. After discussion regarding <br /> the deeding of this 10 foot strip, and the feasibility of acquiring the deed now rather <br /> than wait until the widening is to be accomplished and have to remove the buildings, Coun- <br /> cilman Spillers brought up the idea of setting plan lines for the 10 foot set back on Spruce <br /> Street and a permit be granted to allow these people to operate their business. City Attor- <br /> ney advised the Council that the plan lines have been set, and the use permit was authorized <br /> providing the owners of the property give •a deed to the property and reserving the right to <br /> use it until such time as the City wants it for public use. If the Council decides to do <br /> otherwise, the owners have the right to appeal and a public hearing should be set. Mr. <br /> Bond stated his appearance was an appeal from the issuing of the use permit under the con- <br /> ditions of deeding property to the City. He stated that Mr. McGarvey is asking that the <br /> II Council consider removing this one contingency for a use permit. Councilman Spillers moved <br /> that public hearing be set for May 31st, seconded by Councilman Royer and carried. Build- <br /> ing Inspector advised the Council that the existing building is non - conforming and that Mr. <br /> McGarvey was informed of this fact in the Building Inspector's Office. Motion carried. <br /> City Attorney advised that if the 30 day period from the time the use permit was issued had <br /> expired, then the people will have to make a new application, but if the period has not <br /> expired, then the appeal is good and public hearing will be set. He checked in the minutes <br /> of the Planning Commission and found that the use permit was granted April 26th, therefore <br />
