6.1.D. - Page 6 <br />acts, omissions, negligence or willful misconduct of DU or its officers, agents, <br />employees, servants, contractors or subcontractors, provided that this indemnity shall <br />not apply to claims for which one or more of Indemnitees have been found in a court of <br />competent jurisdiction to be solely liable by reason of its or their own active negligence <br />or willful misconduct. <br />DU waives any and all rights to any type of express or implied indemnity or right <br />of contribution from the City, its officers, agents, or employees, for any liability resulting <br />from, growing out of, or in any way connected with or incident to this Agreement. <br />The duty of DU to indemnify and save harmless, as set forth herein, shall include <br />the duty to defend as set forth in Section 2778 of the California Civil Code. <br />8. INSURANCE <br />A. DU shall acquire and maintain Workers Compensation, employer's <br />liability, commercial general liability, owned and non -owned and hired automobile liability <br />insurance coverage (if applicable as indicated below) relating to DU's activities funded <br />hereunder. The minimum amounts of coverage corresponding to the aforesaid <br />categories of insurance per insurable event shall be as follows: <br />Insurance Cateaory <br />Workers Compensation <br />Employer's Liability <br />Minimum Limits <br />statutory minimum <br />$1,000,000 per accident <br />for bodily injury, personal <br />injury and property damage <br />Commercial General <br />$1,000,000 per occurrence <br />Liability <br />for bodily injury, personal <br />injury, and property damage. <br />If the submitted policies contain aggregate <br />limits, general aggregate limits will apply <br />separately to the work under this Agreement <br />or the general aggregate will be twice the <br />required per occurrence limit. <br />Course -of- Construction <br />Completed value of the project with <br />(Builder's Risk) <br />no coinsurance penalty provisions. <br />Automobile Liability ISO Form Number CA 0001, Code 1 <br />B. Concurrently with the execution of this Agreement, DU shall furnish City <br />with certificates and copies of information or declaration pages of the insurance required <br />hereunder and, with respect to evidence of commercial general liability and automobile <br />liability insurance (if applicable) coverage, original endorsements: <br />ATTY /AGR /2011.009 /DUCKS UNLIMITED <br />032511 revised final version <br />
