CLIENT RESPONSIBILITIES: CLIENT will provide necessary staff time to work with CONTRACTOR to gather <br /> information to perform SCOPE and will have the technical knowledge, expertise, and /or written materials necessary for <br /> CONTRACTOR to perform the SCOPE. Additionally, CLEINT shall: <br /> • Provide copies of pertinent organizational policies and informational documentation <br /> • Assign facility /site contact(s) to coordinate site visits and training events and ensure that the appropriate <br /> personnel and information are available <br /> • Provide copies of written environmental, health and safety procedures (as applicable) <br /> • Provide regulatory agency inspection reports (as applicable) <br /> • Provide copies of written safety and health programs <br /> • Provide information on employee training <br /> • Provide additional information requested by CONTRACTOR in preparation for and following up on facility/site <br /> visits and staff meetings (as required) <br /> STANDARD OF CARE AND WARRANTY: CONTRACTOR will perform the work under this Agreement as an <br /> independent contractor and in accordance with generally accepted professional practices. CONTRACTOR will utilize <br /> reasonable care and skill consistent with and equal to that customarily possessed by environmental, health and safety <br /> consulting professionals in the community. <br /> The parties recognize the complex, subjective, and performance based nature of many environmental, occupational <br /> safety and health laws and regulations and the administrative interpretations thereof. <br /> In performance of the work, CONTRACTOR must rely upon information derived from secondary sources and personal <br /> interviews. Except as specifically required in the scope of work, CONTRACTOR will make no independent <br /> investigation as to the accuracy of completeness of the information derived from the secondary sources and personal <br /> interviews, n will <br /> and assume that such information is accurate and complete. <br /> All recommendations, findings, and conclusions will be based upon information and circumstances as they existed at <br /> the time of preparation (e.g. Federal, state, and local laws; political climate; and other matters that CONTRACTOR <br /> deemed relevant). A change in any fact or circumstance may adversely the recommendations, findings, and <br /> conclusions expressed in this report.
