6.3.B. - Page 17 <br /> 5.�� C�aims far 8�nefits <br /> I�To benefit shall be paid hexeunder unless a Paxticipant,his Spouse or I]ependent has fixst submitted a wxitten claim for <br /> benefits to the Plan Administrator on a foxm specified by the Plan Administratox,and pursuant to the pxocedures set out in <br /> Article VI,below.Upon xeceipt of a properly documented claim,the Plan Administrator shall pay the Participant,his Spouse <br /> or L3ependent the benefits provided under this Plan as soon as is administratively feasible. <br /> ARTl�LE V� <br /> Plan Administra�ion <br /> 6.�� Allaeatian af Authori�y <br /> s <br /> The Employer sha�I control and manage the operation and Administration of the Plan.The Employer shall have the exclusive <br /> right to interpxet the Plan and to decide all matters arising thereunder,including the right to remedy possible ambiguities, <br /> inconsisten�ies,or omissions.AII determinations of the Employer with respect to any matter hereunder shall be conclusive and <br /> binding on alI pexsons. <br /> Without limiting the generality of the foregoing,the Employer shall have the following powers and duties: <br /> a} To decide on questions concerning the Plan and the e�igibility of any Employee to participate in the Plan,in accordance <br /> with the pxo�i�sions of the Plan; <br /> b} To detexmine the amount of benefits that shall be payable to any person in accoxdance with the provisions of the Plan;to <br /> infoxm the Plan Administxator,as appropriate,of the amount of such Benefits;and to pro�ide a full and faix xe�iew to any <br /> Participant whose claim fox benefits has been denied in whole ox in part;and <br /> c} To designate other persons to carry out any duty or power which would otherwise be a f�duc.iary xesponsibility of the Plan <br /> Administrator,under the terms of the Plan. <br /> d} To require any person to furnish such reasonable infarmation as it may request for the purpose of the proper administration <br /> of'the PIan as a condition ta receiving any benefits under the Plan; <br /> e} To make and enforce such rules and regulations and prescxibe the use of such forms as he shall deem necessary fox the <br /> efficient administration of the Plan. <br /> 6.�2 Pra�isian far Third-Party P�an Ser�ice Pra�iders <br /> The Plan Administratox,subject to appro�al of the Employer,may employ the services of such persons as it may deem <br /> necessary or desirable in connection with operation of the Plan.The Plan Administxator,the Employer(and any pexson <br /> t�whom it may delegate any duty or power in connection with the administration of the Plan},and alI persons connected <br /> thexewith may rely upon all tables,valuations,certificates,reports and opinions fuxnished by any duly appainted actuary, <br /> accountant, �including Employees who are actuaries or accountants},c�nsultant,thixd party administration ser�vice provider, <br /> legal counsel,ax othex specialist,and they shall be fully pratected in respect to any action taken or permitted in good faith in <br /> reliance thexeon.All actions so taken or permitted shall be conclusi�e and binding as to all persans. <br /> 6.�3 S���ral Fiduciary Liabili�y <br /> To the extent permitted by law,neither the Plan Administrator nor any other persan shall incux any liability for any acts ox for <br /> failuxe to act except fax his own willful misconduct or willful breach of this Plan, ' <br />
