8.A. - Page6 <br /> to aid the general public, agency representatives, and the City's policymakers in making <br /> informed decisions about the Saltworks development proposal (Attachment 7). <br /> The revised scope of work is intended to cover anticipated work from July 2011 through <br /> June 2012. Contract Amendment No. 3 is in the amount of $995,000.00 taking the total <br /> contract value, to $3,111,300.00 ($995,000 + 425,000 + $1,439,300.00 + $252,000). <br /> Perkins Coie LLP <br /> In February, the City Council confirmed Cecily Talbert Barclay and Bingham McCutchen <br /> LLP (her law firm at the time) as special land use counsel to the City to assist in <br /> reviewing and evaluating the Saltworks development proposal. The City Council's <br /> original confirmation specified that, in the event Ms. Barclay switched law firms, her new <br /> firm would be automatically confirmed without additional action required by the Council. <br /> Nonetheless, the recommended action clarifies that Perkins Coie LLP is approved to <br /> provide special counsel services to the City in connection with the Saltworks <br /> development proposal. In addition, the City Attorney has executed a retention letter <br /> with the original confirmation of Ms. Barclay authorized up to $500,000 for work <br /> intended to be completed by June 2011. Ms. Barclay has not incurred all of the <br /> $500,000 of work authorized through June, as a significant portion of this work may now <br /> occur in July 2011 or later, along with the work that is being separately authorized now. <br /> Perkins Coie will continue to provide special land use counsel work associated with all <br /> legal issues arising in connection with the City's review and processing of the <br /> applications for the Saltworks development proposal and the associated environmental <br /> review. The new work scope for Perkins Coie LLP covers anticipated special legal <br /> counsel work between July 2011 and June 2012. It is in addition to the work previously <br /> authorized in February 2011, some of which will also be completed after July 2011. The <br /> new contract is in the amount of $350,000 taking the total contract value to $850,000 <br /> ($350,000+$500,000). <br /> ALTERNATIVES <br /> Council may choose not to approve the revised scopes with Data Instincts, Hart <br /> Howerton, Hauge Brueck Associates, and/or Perkins Coie and direct staff to modify the <br /> scope of work, work with alternative consultant(s), or determine alternative means to <br /> perform and complete the work. <br /> FISCAL IMPACT <br /> The review of the Saltworks development proposal is covered by the Redwood City <br /> planning services cost recovery system and is further subject to an existing <br /> Reimbursement Agreement. Hence, the applicant has submitted deposits to cover the <br /> cost of staff time and consultant services needed for reviewing the development <br /> proposal. <br /> The First Amended and Restated Reimbursement and Processing Agreement <br /> described herein, once approved and executed, will further refine the reimbursement <br /> process, including establishment of an "Evergreen Deposit" to ensure that funds <br />
