6.1.D. - Page 4 <br /> A. Fire JPA agrees to pay City forty percent of Fire Marshal's total salary and <br /> benefit package (normalized PERS rate). Accordingly, Fire JPA's financial <br /> obligation to City for services actually rendered by Fire Marshal pursuant <br /> to this agreement equates to $83,500 on an annual basis and shall be <br /> payable in arrears in quarterly installments in response to invoices from <br /> City. Any proposed adjustment by City to its financial obligation during the <br /> term of this Agreement shall be submitted to Fire JPA for prior approval at <br /> least 60 days prior to effective date of said adjustment. <br /> B. In the event of the termination of this Agreement by either Fire JPA or <br /> City, Fire JPA shall be entitled to payment for the services performed as of <br /> the date of termination. <br /> C. The Fire Marshal shall be on call for Fire JPA in the same way that the <br /> Fire Marshal is on call for the City. If called out between the hours of 1700 <br /> and 0800 or on weekends, the City will bill for travel time, investigation <br /> time and up to four hours to complete the written investigation, which the <br /> Fire Marshal shall deliver to the Fire JPA Chief within 96 hours of leaving <br /> the scene of the investigation. <br /> D. The City shall provide the Fire Marshal with a vehicle for transportation <br /> usages, i.e.: Movement of equipment, meetings, emergency response and <br /> as deemed necessary. <br /> 4. Pa ment. The City shall submit quarterly invoices to Fire JPA reflecting <br /> the hours worked by the Fire Marshal per this Agreement. Payments shall be received <br /> within (30) days of billings. <br /> 5. Emplovment. The designated Fire Marshal shall not be deemed a Fire <br /> JPA employee for any purpose. <br /> A. City's Fire Chief will provide overall supervision of the Fire Marshal. In <br /> the event of a conflict between direction given by City Fire Chief and <br /> Fire JPA Chief, the City Chief and the Fire JPA Chief will meet and use <br /> their best efforts to resolve the conflict. <br /> B. City shall be solely responsible for payment of all salary, benefits, <br /> workers' compensation and insurance for the designated Fire Marshal <br /> and the designated Fire Marshal shall be considered an employee of <br /> City for all supervisory, disciplinary and other employment related <br /> purposes. In the event that the City eliminates the Fire Marshal <br /> classification and does not replace it with a similar classification, this <br /> Agreement shall terminate pursuant to the terms of Section 17, <br /> Termination. <br /> ATTY/AGR/2011. 043 Belmont SC Fire Marshal <br /> 051311 2 <br />
