SB 762 clarifies
the definition of "nonviolent drug possession
offense" by providing that the term means the
unlawful personal use, possession for personal
use, or transportation for personal use of any
controlled substance classified in Schedules l to
V, inclusive. The League agrees with the author,
who states "this bill resolves ambiguity in the
definition of 'nonviolent drug possession offense'
by expressly stating the term means the unlawful
personal use, possession for personal use, or
transportation for personal use of any controlled
substance. The language in this bill will
make clear what the proponents of Proposition 36
have contended all along - that Proposition 36 is
aimed at the treatment for those with substance
abuse problems." SB 824 repeals,
and recasts, the provisions of law pertaining to
licensed firearms dealers "security" requirements
in cities and counties with smaller populations.
This bill specifically authorizes local jurisdictions
to impose greater security requirements
with some restrictions. Specifically, local jurisdic-
tions are permitted to require an additional back-
ground security check beyond the check con-
ducted by DOJ. The League believes that this is
a good public safety measure.
