<br />sion Offense: Personal Use. SB 762 clarifies
<br />the definition of "nonviolent drug possession
<br />offense" by providing that the term means the
<br />unlawful personal use, possession for personal
<br />use, or transportation for personal use of any
<br />controlled substance classified in Schedules l to
<br />V, inclusive. The League agrees with the author,
<br />who states "this bill resolves ambiguity in the
<br />definition of 'nonviolent drug possession offense'
<br />by expressly stating the term means the unlawful
<br />personal use, possession for personal use, or
<br />transportation for personal use of any controlled
<br />substance. The language in this bill will
<br />make clear what the proponents of Proposition 36
<br />have contended all along - that Proposition 36 is
<br />aimed at the treatment for those with substance

<br />SB 824 (Scott). Firearms. SB 824 repeals,
<br />and recasts, the provisions of law pertaining to
<br />licensed firearms dealers "security" requirements
<br />in cities and counties with smaller populations.
<br />This bill specifically authorizes local jurisdictions
<br />to impose greater security requirements
<br />with some restrictions. Specifically, local jurisdic-
<br />tions are permitted to require an additional back-
<br />ground security check beyond the check con-
<br />ducted by DOJ. The League believes that this is
