72-Al <br />REPORT, <br />To Me Honorable Mayor and City Council <br />Prom -the City Mana ear j <br />September 8, 2003 <br />Subject <br />Order the Levy of Benefit Assessments for FY 2003 -04 for the Seaport Centre <br />Maintenance District, Seaport Boulevard Landscape Maintenance District, and <br />Redwood Shores Landscape Maintenance District 1995 -1. <br />Recommendation <br />1. Adopt a Resolution ordering the Levy of Benefit Assessments for FY 2003 -04 <br />for the Seaport Centre Maintenance District <br />2. Adopt a Resolution ordering the Levy of Benefit Assessments for FY 2003 -04 <br />for the Seaport Boulevard Landscape Maintenance District, and <br />3. Adopt a Resolution ordering the Levy of Benefit Assessments for FY 2003 -04 <br />for the Redwood Shores Landscape Maintenance District 1995 -1. <br />Background <br />These three, relatively small Assessment Districts have annual assessments <br />amounting anywhere from $125,000 to $300,000. The Seaport Centre Maintenance <br />District and the Seaport Boulevard Landscape Maintenance District were established <br />in 1987, and the Redwood Shores Landscape Maintenance District was formed in <br />1995. The Districts were formed to pay for the maintenance of facilities that were <br />determined to be above and beyond the normal level of maintenance that is required <br />in the rest of the City (i.e., stormwater pump stations, sewage pump stations, levee <br />systems, and extra landscaping). <br />Proposition No. 218, voted into law in 1996 in an effort to control the increasing use of <br />special taxes, requires any increase in existing assessment levies to be approved by <br />a majority vote of affected property owners. It further requires that existing districts be <br />confirmed by property owners in the district to ensure that districts are still beneficial <br />to the owners. The Districts were confirmed in 1998 and 2000. <br />Prior to the year 2000 confirmation, budgets, assessments, and the authority to levy <br />special taxes were formulated, and enacted on an annual or bi- annual basis. With the <br />Proposition No. 218 confirmation, in an effort to streamline the proceeding and reduce <br />overhead costs, five -year budgets and assessments were prepared for the Seaport <br />Districts, and an automatic escalation clause was formulated for the Redwood Shores <br />Landscape Maintenance District in 1998. The City Manager's Report, budgets, <br />assessments, and authority to levy taxes (for the five years and with the escalation <br />clause) were approved by the City Council in 1998 and 2000. <br />For the past three years, without incident, taxes were levied and collected, through <br />the San Mateo County Tax Controller and Collector's Office using these authorities. <br />However, due to changes in operating policies/procedures at the San Mateo County <br />Page 1 of 2 <br />
