i <br />Legislative Bill Action <br />................................ ............................... <br />local agency any increased costs incurred by the <br />contractor as a result of any decision that classi- <br />fies, after the time at wh, h the awarding body <br />accepts the contractor's bid, a project as a "public <br />work." Under current law prevailing wages are <br />required to be paid on local public projects that are <br />"public works" - this is not in dispute. Unfortu- <br />nately, this bill imposes on local agencies the cost <br />for prevailing wages and penalties in circum- <br />stances where, through no fault of the local <br />agency, a construction contractor or subcontrac- <br />tor fails to pay prevailing wages to its workers. <br />This bill could cost local agencies millions of <br />dollars a year in added costs and penalties that <br />should have been paid by others. Storage Charge. <br />This bill, a state mandate, could negatively impact <br />a city's contracts with tow companies, and may <br />require cities to change their current policies. <br />Specifically, AB 625 would require: 1) A storage <br />facility operator who holds a vehicle that is placed <br />in storage (upon the demand of the registered <br />owner or owner's agent) shall release the vehicle <br />within one hour if the demand is made during the <br />storage facility's normal business hours or within <br />two hours if that demand is made after normal <br />business hours, but during a time the storage <br />facility operator or keeper is releasing vehicles, if <br />the following conditions are apply: a) the vehicle <br />was removed from a location within two miles of <br />the venue of a special event for which a permit <br />was obtained from a city or county and was <br />removed up to six hours before, or six hours after, <br />that event; b) the towing service responsible for <br />the tow was under contract with the city or county <br />for the removal of vehicles parked in violation of <br />subdivision (n) of Section 22651; c) At least 48 <br />hours prior to the occurrence of the special event, <br />the towing service and, if different, the storage <br />facility operator or keeper was informed in writing <br />by the city or county about the special event and <br />its hours of operation; 2) Additionally this bill <br />requires a city or county to provide written notifica- <br />tion to each affected towing service and storage <br />facility operator or keeper at least 48 hours prior to <br />the occurrence of a special event. For purposes <br />of this subdivision, an affected towing service or <br />storage facility operator or keeper is a service, <br />operator, or keeper that is under contract with the <br />city or county for removal, or storage, or both, of <br />vehicles parked in violation of subdivision (n) of <br />Section 22651. Also a special event is an event for <br />which a permit was obtained from a city or county; <br />and 3) Furthermore, this bill provides that a stor- <br />age facility operator or keeper who is in violation of <br />subdivision (1) may not impose any storage <br />charges for the vehicle. Staff: Natasha Fooman; <br />Status: SenApps; Hrg -8/26, Position: Oppose. <br />HOUSING AND LAND USE <br />AB 1426 (Steinberg). Sacramento Region. <br />Affordable Housing Standard. This bill requires <br />at least 10 percent of new building permits within <br />the Sacramento region to be built for low and very <br />low- income households. While the goal of the bill <br />is laudable, it unfortunately fails to identify or <br />provide funding to offset costs to local govern- <br />ments. Affected local governments have esti- <br />mated the total subsidy cost to the region at over <br />$500 million over a five -year period, and higher <br />when factoring in recent state - imposed prevailing <br />wage requirements. The author waived presenta- <br />tion of AB 1426 on Monday in the Senate Appro- <br />priations Committee and the bill was placed on <br />the suspense file. Assembly Member Steinberg's <br />staff is currently meeting with builders and hous- <br />ing advocate groups to generate realistic cost <br />estimates, but — consistent with the pattern of <br />these discussions — the affected local govern- <br />ments are not invited to participate. The bill's <br />prospects remain uncertain. If the development <br />costs prove to be excessive, the California Build- <br />ing Industry Association is expected to oppose the <br />bill. Traditional Tribal Cultural <br />Sites. SB 18 incorporates language reminiscent <br />of last year's SB 1828 (Burton).
