Legislative Bill Action <br />................................ ............................... <br />GPAC. Staff: Natasha Fooman, Status: SenFlr <br />Position: Support. <br />AB 1044 (Negrete McLeod). Licenses to <br />Carry Firearms. AB 1044 makes specked <br />changes in the statutes pertaining to licenses to <br />carry concealable weapons (CCWs) in California. <br />AB 1044 removes the Department of Justice's <br />(DOJ) obligation to file and store all copies of <br />CCW permits and, instead, requires DOJ to <br />maintain a list of all CCWs. The DOJ has no <br />supervisory authority or oversight over sheriffs and <br />police chiefs regarding the issuance of these <br />permits, therefore making them unnecessary. <br />The obligation to file and store copies of CCW <br />permits results in significant burdens and ex- <br />penses with no benefits to DOJ. AB 1044 pro- <br />vides that DOJ will no longer be required to main- <br />tain hard copy printouts of firearm- related informa- <br />tion in its databases. Commonly, digital formatting <br />is the preferred and most efficient means to <br />provide such information, with less cost. AB 1044 <br />also relieves DOJ of the obligation to adopt and <br />implement the Standard CCW application form <br />and provides that DOJ review and, as necessary, <br />revise the standard CCW application. This bill <br />exempts the CCW applications form from the <br />requirements of the Administrative Procedures Act <br />by stating that the standard form is deemed to be <br />a local form and thus exempt from that Act. Staff: <br />Natasha Fooman, Status: SenFlr, Position: <br />Support. <br />AB 1186 (Strickland). Gambling Control <br />Act. Proposition Player Services. AB 1186 <br />requires the California Gambling Control Commis- <br />sion (CGCC) to issue licenses for proposition <br />player services only to persons that CGCC is <br />satisfied are of good character and whose prior <br />activities, including any criminal record, do not <br />pose a threat to public interest, or to the effective <br />regulation and control of gambling. This bill is <br />intended to ensure that people who have had <br />criminal convictions cannot be issued a license to <br />become a proposition player. According to the <br />author, AB 1186 is needed to maintain the integrity <br />of the proposition player industry. This bill is <br />important to public safety because it prevents <br />players with criminal records from participating in <br />local gambling at lodian casinos, thus eliminating <br />problems that may ve associated with such an <br />individual, which could require additional law <br />enforcement in certain incidences. Staff: <br />Natasha Fooman, Status: SenFlr, Position: <br />Support. <br />SB 814 (Vincent). Gambling. The League <br />opposes SB 814 relative to legal gaming and <br />gaming licenses. As Indian gaming has begun to <br />spread rapidly, with very few controls, SB 814 <br />would further limit local government rights and <br />voter control. SB 814 modifies license require- <br />ments for card clubs. Specifically, it increases a <br />moratorium on the construction and licensing of <br />new non - Indian gambling establishments (i.e., <br />card clubs) from January 1, 2007 to January 1, <br />2010. SB 814 also authorizes the California <br />Gambling Control Commission to renew a gam- <br />bling license for a period of up to five years. <br />Expanding the moratorium on construction and <br />licensing of non - Indian gaming establishments <br />benefits both existing "card clubs' and "Indian <br />Gaming' by effectively halting local governments <br />from approving new gaming facilities for an addi- <br />tional three years, thus extending the monopoly <br />these establishments currently maintain. Further- <br />more, this limits the right of the voters to approve <br />local gambling establishments. <br />The League opposes any action to eliminate <br />the option of a California municipality to act by a <br />vote of the people to authorize gaming locally. The <br />League believes the current moratorium on <br />gaming, January 1, 2007, should not be changed. <br />Extending the date to January 1, 2010, will result in <br />unregulated Indian Gaming establishments <br />throughout the state, with no funding mechanism <br />for cities to mitigate gaming impacts on the local <br />community.
