It <br />has received no negative votes and passed both <br />the Senate and Assembly on near unanimous <br />votes. SB 196 clarifies existing law regarding the <br />composition of the nine regional water quality <br />control boards. Existing law provides that one <br />member of the regional board shall be "associated <br />with municipal government" and one member <br />shall be "associated with county government." SB <br />196 clarifies that the individuals in the "associated <br />with" municipal or county government shall be a <br />mayor or council member, or a county supervisor. <br />It does not impact any individual currently serving <br />on a regional board, but only when a vacancy <br />occurs and new appointment is made. Capitol Facility Fees. <br />AB 1051 which is of interest to cities with munici- <br />pal waste water, water or electric utilities, is <br />pending on the Senate Appropriations Suspense <br />file while amendments are being considered and <br />several technical issues are being negotiated. AB <br />1051, an important measure for local govern- <br />ments, clarifies existing law regarding capital <br />facility fees and ensures that cities are not forced <br />to pay refunds to schools and other public agen- <br />cies for previously and appropriately charged utility <br />fees The author has accepted numerous amend- <br />ments in an attempt to respond to concerns <br />raised by the education community, legislators <br />and the Attorney General's office. AB 1051 is an <br />important bill for cities in order to avoid increased <br />litigation. In anticipation of the bill moving from the <br />suspense file to the Senate Floor, cities are <br />encouraged to write their Senators and urge an <br />AYE vote A fact sheet on AB 1051 is available on <br />the League's Web site. SB 20 establishes a program for the <br />collection and recycling of hazardous electronic <br />waste, such as computer monitors and televi- <br />sions In its current form, the bill would provide <br />manufacturers of electronic products that become <br />electronic waste flexibility in how to assume their <br />manufacturer responsibility for dealing with these <br />products when they become waste — products <br />which have been designated as hazardous waste <br />by the State Department of Toxic Substances <br />Control and thus are prohibited from being dis- <br />posed in a solid waste landfill. All products cov- <br />ered under the bill would include a modest up -front <br />fee paid by the consumer at the retail level to fund <br />e -waste collection and consolidation programs. <br />Manufacturers would then have the choice of <br />either establishing programs to dismantle and <br />recycle their products or of paying a fee to cover <br />the cost of such programs carried out by others. <br />Local governments, their contact haulers, non- <br />profit organizations and others would be have the <br />option to become an "authorized collector" and <br />thus be eligible to receive funding for providing e- <br />waste collection programs. <br />SB 20 was heard again this week in the <br />Assembly Appropriations Committee. After an <br />extensive discussion and testimony by supporters <br />and opponents, the bill was placed on the Sus- <br />pense File. It is anticipated to between now and <br />the time when SB 20 will hopefully be removed <br />from the suspense file, it will be amended to <br />respond to many of the issues raised during the <br />hearing and by interested groups. The author's <br />office has agreed to accept an important technical <br />amendment requested by the League to clarify the <br />local fee authority provision in the bill. While the <br />Governor has indicated a willingness to sign an E- <br />waste bill this year, it first has to pass the Legisla- <br />ture in order for him to do so.
