<br />SB 402 provided that if a collective bargaining
<br />impasse regarding economic issues has been
<br />declared between a local government and repre-
<br />sentatives of specified public safety employees,
<br />and if other available administrative remedies
<br />have been exhausted, the employee organization
<br />may request submission of the differences to
<br />binding interest arbitration. That law also provided
<br />that the decision of the arbitrator on economic
<br />issues was binding on the parties.
<br />SB 440 attempts to defeat the decision of the
<br />Supreme Court in County of Riverside v Superior
<br />Court by the dubious provision that the decision of
<br />the arbitrator may be overturned by a unanimous
<br />decision of the board of supervisors or city coun-
<br />cil. This option is nearly impossible to achieve
<br />and we question whether it will survive subse-
<br />quent constitutional challenges on the same basis
<br />that SB 402 was found unconstitutional. Staff:

<br />AB 1141 (Diaz). Meyers Milias Brown Act.
<br />Agency Shop Agreements. Cities are urged to
<br />contact the Governor requesting a "VETO" on AB
<br />1141. This bill would amend the local agency
<br />collective bargaining law, known as the "Meyers -
<br />Milias -Brown Act" (MMBA) to extend agency shop
<br />agreements to confidential and supervisory
<br />employees. The MMBA, unlike most employment
<br />law including those affecting most of the other
<br />public employees in this state, generally permits
<br />management and confidential employees to join
<br />represented units of employees and to participate
<br />in the collective bargaining process. This creates
<br />a built -in conflict of interest for management and
<br />confidential employees that does not exist in other
<br />labor laws. The MMBA provides for agency shop
<br />agreements that can be imposed without the
<br />agreement of the local agency and would gener-
<br />ally require union membership or aftemative dues
<br />payment from all members of a bargaining unit.
<br />In recognition of the conflict between forced
<br />participation of management and confidential
<br />employees in employee groups, they have been
<br />exempted from the agency shop provisions of
