8. X413
Legislative Bill Action
................................ ...............................
SB 402 provided that if a collective bargaining
impasse regarding economic issues has been
declared between a local government and repre-
sentatives of specified public safety employees,
and if other available administrative remedies
have been exhausted, the employee organization
may request submission of the differences to
binding interest arbitration. That law also provided
that the decision of the arbitrator on economic
issues was binding on the parties.
SB 440 attempts to defeat the decision of the
Supreme Court in County of Riverside v Superior
Court by the dubious provision that the decision of
the arbitrator may be overturned by a unanimous
decision of the board of supervisors or city coun-
cil. This option is nearly impossible to achieve
and we question whether it will survive subse-
quent constitutional challenges on the same basis
that SB 402 was found unconstitutional. Staff:
Amy Brown, Status: Governor's Desk, Position:
Oppose.
AB 1141 (Diaz). Meyers Milias Brown Act.
Agency Shop Agreements. Cities are urged to
contact the Governor requesting a "VETO" on AB
1141. This bill would amend the local agency
collective bargaining law, known as the "Meyers -
Milias -Brown Act" (MMBA) to extend agency shop
agreements to confidential and supervisory
employees. The MMBA, unlike most employment
law including those affecting most of the other
public employees in this state, generally permits
management and confidential employees to join
represented units of employees and to participate
in the collective bargaining process. This creates
a built -in conflict of interest for management and
confidential employees that does not exist in other
labor laws. The MMBA provides for agency shop
agreements that can be imposed without the
agreement of the local agency and would gener-
ally require union membership or aftemative dues
payment from all members of a bargaining unit.
In recognition of the conflict between forced
participation of management and confidential
employees in employee groups, they have been
exempted from the agency shop provisions of
MMBA Staff: Amy Brown, Status: Govemor's
Desk, Position: Oppose.
WANT TO SEND A LETTER IN
SUPPORT OF A LEAGUE POSITION?
HERE'S WHO TO CONTACT:
ASSEMBLY APPROPRIATIONS COM-
MITTEE (AsApps): Steinberg (D)(Chair),
Bates (R)(Vice Chair), Berg (D), Calderon (D),
Corbett (D), Correa (D), Daucher (R), Diaz
(D), Firebaugh (D), Goldberg (D), Haynes (R),
Leno (D), Maldonado (R), Negrete McLeod (D),
Nation (D), Nunez (D), Pacheco (R), Pavley
(D), Ridley- Thomas (D), Runner (R),
Samuelian (R), Simitian (D), Wiggins (D), and
Yee (D).
