the problem is unacceptable; and (d) A listing of specific actions <br />requested of the City which will remedy the grievance. <br /> <br />17.3.2.2 <br /> <br />The Chief of Police shall communicate the decision to the <br />gxievant in writing within ten (10) days afier receiving the <br />grievance. If the Chief of Police does not respond within the <br />time limits, the grievant may appeal to the next level. <br /> <br />17.3.2.3 Within the above time limits either party may request a personal <br /> conference. <br /> <br />17.3.2.4 <br /> <br />Prior to determining the level of discipline to be taken on alleged <br />violations of City or Department rules and/or regulations, the <br />Chief or his designee will: <br /> <br />Ascertain if the represented employee wishes the <br />Association to intervene on their behalf prior to the decision <br />being made by the Chief as to level of discipline. <br /> <br />In those cases where intervention is not desired, the Chiefs <br />decision will be made without Association intervention. <br />Denial of Association involvement at this level does not <br />affect any other part of the grievance procedure contained in <br />this MOU. <br /> <br />When intervention is desired, the Chief will contact the <br />President or their designee to schedule a meeting where the <br />representative will be granted access to the investigative file. <br />This access will not include the fight to copy any portion of <br />the file in question. Appropriate copies will be made <br />available after the actual discipline is determined. After <br />being given a reasonable amount of time to read the file, the <br />Chief will listen to confdenfial, oral input as it relates to the <br />actual level of discipline to be taken. Association <br />involvement at this level, does not affect any other part of <br />the grievance procedure contained in this MOU. <br /> <br />The entire process bom date of notification to the POA, by <br />the Chief, will be no longer than ten (10) working days <br />unless extended by mutual agreement. <br /> <br />5. All communications between the Chief and the Association <br /> at this level is advisory and confidential. <br /> <br />17.3.3 Level IH - Aooeal to Personnel Officer <br /> <br />17.3.3.1 If the grievant is not satisfied with the decision at Level II, the <br /> grievant may within ten (10) days of the receipt of the decision at <br /> <br />3O <br /> <br /> <br />
