2. To accept assignment from Belmont of the following contracts for planning, engineering and other professional services in connection with the Project: A. Mark Thomas & Co. for engineering design and construction administration services, dated March 29, 1999. B. The County of San Mateo for land acquisition services in connection with the right of way to be acquired by Redwood City, dated April 3, 2001 (Council Resolution No. 8969 Contract Number 402). 3. To pay all charges for planning and engineering and other professional services performed under the contracts identified in Article 2 of Section 1 after the date Redwood City accepts the assignment. 4. To apply for necessary encroachment permits from the State that are required for the Project in accordance with the State of California's standard permit procedures for construction work within the State highway right of way. 5. To advertise, award, and administer the construction contract for the Project in accordance with the requirements of the Public Contract Code and the California Labor Code, including prevailing wage provisions. Workers employed in the performance of work contracted for by Redwood City and/or performed under encroachment permit, are covered by provisions of the Labor Code in the same manner as are workers employed by contractors to the State. Redwood City shall obtain applicable wage rates from the State Department of Industrial Relations and shall adhere to the applicable provisions of the State Labor Code. Violations shall be reported to the State Department of Industrial Relations. The contract shall include the Federal DBE requirements as contained in Title 49 CFR, Part 23. 6. To require the construction contractor to furnish both a payment and performance bond in Redwood City's name before commencing any construction work on the Project. Both bonds shall comply with the requirements set forth in Section 3- 1.02 of the State's current Standard Specifications. 7. To including in the bid documents for the Project plans and specifications for completion of a pavement overlay on Ralston Avenue (the "Overlay Project"), as more fully described in Section II, below, provided that Belmont meets the obligations set forth in Section II, below, in connection with the Overlay Project. 8. To contract for construction of the Project based on the Plans, Specifications, and Estimate (PS&E) prepared by the consultants identified in Article 2(A) of Section I, and to the satisfaction of and subject to the approval of the State. 9. To administer the Project in accordance with the contract administration procedures set forth in the State's Construction Manual, Local Assistance Procedures F:Atty/Agr/Agr. 149 080503 L.BECK 2
