2. To accept assignment from Belmont of the following contracts for planning, <br />engineering and other professional services in connection with the Project: <br /> <br /> A. Mark Thomas & Co. for engineering design and construction <br />administration services, dated March 29, 1999. <br /> <br /> B. The County of San Mateo for land acquisition services in connection with <br />the right of way to be acquired by Redwood City, dated April 3, 2001 (Council <br />Resolution No. 8969 Contract Number 402). <br /> <br />3. To pay all charges for planning and engineering and other professional services <br />performed under the contracts identified in Article 2 of Section 1 after the date <br />Redwood City accepts the assignment. <br /> <br />4. To apply for necessary encroachment permits from the State that are required for <br />the Project in accordance with the State of California's standard permit procedures for <br />construction work within the State highway right of way. <br /> <br />5. To advertise, award, and administer the construction contract for the Project in <br />accordance with the requirements of the Public Contract Code and the California Labor <br />Code, including prevailing wage provisions. Workers employed in the performance of <br />work contracted for by Redwood City and/or performed under encroachment permit, <br />are covered by provisions of the Labor Code in the same manner as are workers <br />employed by contractors to the State. Redwood City shall obtain applicable wage rates <br />from the State Department of Industrial Relations and shall adhere to the applicable <br />provisions of the State Labor Code. Violations shall be reported to the State <br />Department of Industrial Relations. The contract shall include the Federal DBE <br />requirements as contained in Title 49 CFR, Part 23. <br /> <br />6. To require the construction contractor to furnish both a payment and <br />performance bond in Redwood City's name before commencing any construction work <br />on the Project. Both bonds shall comply with the requirements set forth in Section 3- <br />1.02 of the State's current Standard Specifications. <br /> <br />7. To including in the bid documents for the Project plans and specifications for <br />completion of a pavement overlay on Ralston Avenue (the "Overlay Project"), as more <br />fully described in Section II, below, provided that Belmont meets the obligations set <br />forth in Section II, below, in connection with the Overlay Project. <br /> <br />8. To contract for construction of the Project based on the Plans, Specifications, and <br />Estimate (PS&E) prepared by the consultants identified in Article 2(A) of Section I, and <br />to the satisfaction of and subject to the approval of the State. <br /> <br />9.
