C. The parties specifically waive right to a pro rata allocation of liability under <br /> Cal. Gov't Code section 895.6. <br /> D. The parties expressly agree that this section shall survive the expiration or <br /> early termination of the Agreement. <br /> 10. Insurance Requirements. Parties shall obtain and maintain for the <br /> duration of the Agreement and any and all amendments, insurance against claims for <br /> injuries to persons or damage to property which may arise out of or in connection with <br /> performance by the Parties in the amounts specified below: <br /> A. Commercial General Liability Insurance. $1,000,000 combined single -limit per <br /> occurrence for bodily injury, personal injury and property damage. If the <br /> submitted policies contain aggregate limits, general aggregate limits will apply <br /> separately to the work under this Agreement or the general aggregate will be <br /> twice the required per occurrence limit. <br /> B. Automobile Liability. $1,000,000 combined single -limit per accident for bodily <br /> injury and property damage. <br /> C. Workers Compensation. Coverage meeting or exceeding statutory limits. With <br /> respect to Workers Compensation coverage, Fire JPA will provide Workers <br /> Compensation coverage for any injuries sustained in the normal course and <br /> scope for the designated Training Officer's performance of the services. <br /> D. Additional Provisions. Parties will ensure that the policies of insurance required <br /> under this Agreement contain, or are endorsed to contain, the following <br /> provisions: <br /> • For Commercial General Liability Insurance and Automobile <br /> Liability Insurance: Each respective Party's officers, agents, <br /> volunteers and employees will be named as additional insureds. <br /> • This insurance will be in force during the life of the Agreement and <br /> any extensions of it and will not be canceled, reduced, or materially <br /> changed without thirty (30) days prior written notice sent pursuant <br /> to the Notice provisions of this Agreement. <br /> • Providing Certificates of Insurance and Endorsements. Prior to <br /> execution of this Agreement, Parties will exchange certificates of <br /> insurance and endorsements. <br /> • Submission of Insurance Policies. Respective Parties reserve the <br /> right to require, at any time, complete and certified copies of any or <br /> all required insurance policies and endorsements. <br /> • Primary Coverage. Respective Parties' insurance coverage will be <br /> primary insurance with respect to other Party, its officers, agents, <br /> volunteers and employees.
