<br />~.B -1 <br /> <br />REPORT <br /> <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />February 28, 2005 <br /> <br />Subject <br />Adoption of a Resolution Confirming City Council Policy with respect to development on <br />Laurel Way <br /> <br />Recommendation <br />That the City Council adopt the attached resolution confirming their policy with respect to <br />the development of vacant sites on Laurel Way as follows: <br />1. Determine that the December 18, 2000 staff report and Exhibit A to Resolution 14111 <br />(a map) accurately represent the Council's policy with respect to the location ofthe "EIR <br />- No EIR Line;" <br />2. Adopt the attached Resolution which clearly states the policy as it is presented in the <br />December 18, 2000 staff report and Exhibit A in regards to determining the location of <br />the "EIR - No EIR Line." <br /> <br />Background <br />Laurel Way is a private street located on the north side of a steeply sloping hill within the <br />Emerald Hills neighborhood planning area. Utilities are not readily available to many <br />parcels fronting on Laurel Way and emergency access is significantly substandard along <br />this street, except for at the eastern end where the roadway is improved to City standards. <br />About half of the parcels fronting on laurel Way remain vacant. In general, the.se lots have <br />significant slopes, may contain unstable soils, and are blanketed with native vegetation and <br />habitat. The laurel Way roadway includes three surface conditions: improved to City <br />standards at the east end; paved but significantly substandard and narrow in the center <br />section; and unpaved and substandard for the entire western end. <br /> <br />Existing City Council policy, established in 1988 and modified in 2000, states that no <br />further development should occur on parcels fronting the substandard portions of Laurel <br />Way (the west end of the street) until an Environmental Impact Report (EIR) is prepared. <br />On December 18, 2000, a line was established by Council which specified which parcels <br />would require an EIR for development and which would not. This line will be referred to <br />throughout this report as the "EIR - No EIR Line." Development requirements for properties <br />on the EIR side of the line also include a comprehensive street and utilities improvement <br />plan as well as technical studies. A map of laurel Way indicating the remaining vacant <br />properties; the roadway surface conditions; and the location of the EIR - No EIR Line is <br />provided below for reference. In 2000, City Council established the EIR - No EIR Line at <br />the transition point from the City standard paved section to the substandard paved section. <br /> <br />Recently, the property owner of 3730 laurel Way (a vacant lot), has made staff aware of a <br />need for clarification between the Staff Report from December 18, 2000 and the <br />associated Resolution. Both documents describe the location of the EIR - No EIR line <br />using different references. Staff has met with the property owner and there was a <br />
