The property owner believes that his property, which <br />fronts on the paved, but significantly substandard, portion of Laurel Way, should not be <br />subject to the EIR requirement. Staff believes that 3730 Laurel Way is located on the EIR <br />side of the line as indicated in the map below. December 18. 2000 Staff Report: The staff report clearly describes the location of the <br />line. It very specifically indicates that only two vacant parcels (3718 and 3724 Laurel <br />Way as shown on the map above) would be on the side ofthe line not requiring an EIR. <br />(A third vacant parcel west of 3717 would also qualify; however, it is under the same <br />ownership as 3717 which functions as a "double-lot" property.) The first page of the <br />staff report states that "development may occur on these two parcels without <br />preparation of an EIR and related studies, and not on any vacant parcels along Laurel <br />Way beyond the improved lot at 3726 Laurel Way." The staff report repeats this <br />determination several more times, for example, this statement is included on page 2: <br />"All other vacant parcels along Laurel Way that are located westerly of 3726 Laurel <br />Way would have to comply with the requirement that an EIR and technical studies <br />(geographical, engineering, etc.) covering the entire undeveloped area be prepared <br />prior to any development..." It is important to note that this description positions the line <br />at the transition between the City standard and substandard paved portions as shown <br />on the above map. <br />. Resolution 14111: The resolution does not specify the location of the EIR - No EIR <br />Line based on addresses or parcels numbers for any of the properties. Rather, it refers <br />generally to pavement condition. In language for establishing the line, the resolution <br />
