Equipment "change out" and overhaul can <br />OCcur any time with 30 days notice to the Director to allow notice to property <br />owners and residents within 300 feet of the facility. <br />14. Once the wireless communications facility is operating, the City will require <br />that the ApplicantiPermitee submit documentation confirming that the facility <br />is operating within the technical standards as described in the application <br />and the Federal Communications Commission permit. Independent field <br />strength or power density measurements (by and Independent company and <br />at the expense of the applicant) shall be provided to the Zoning <br />Administrator within 30 days of issuance of a permit to activate the facility by <br />the City Building Department. A baseline field strength and power density <br />measurement of the subject area shall also be provided to the Zoning <br />Administrator prior to the activation of the proposed facility. <br />15. Within thirty days before or after the first annual anniversary of when the City <br />issues the final building permit to operate the facility, and thereafter at five <br />year intervals, the Applicant/Permitee shall submit the following information, <br />in writing, to the Zoning Administrator: <br /> <br />a. Confirmation that the facility continues to operate in compliance with all <br />terms and conditions of approval by the City. <br />b. Independent field strength or power density measurements taken within <br />the past 30 days that verify that the facility continues to operate in <br />compliance with all terms and conditions and emissions standards <br />imposed by the Federal Communications Commission. <br />c. Confirmation that there is no equipment available that would enhance <br />the safety, efficiency, and/or reduce the noise, intensity, radiationand/or <br />or visibility and size of the facility. ' <br />d. Confirmation that there are not more appropriate locations available for <br />the facility. <br />e. Confirmation that the facility continues to function as an essential <br />element of the ApplicantiPermitee's network. <br />f. Documentation of any complaints received by the Applicant/Permitee <br />since the inception of operations regarding the operation and <br />maintenance of the facility, Including the Applicant/Permitee's action to <br />address the complaints. <br />16, This Use Permit shall be subject to review within one year from the date of <br />issuance of a certificate of operation (final) by the City Building Department. <br />In the event that the City receives significant complaints (as determined by <br />the City) regarding this facility, the City may review and revise the conditions <br />this Use Permit in a public forum, per Article 42 of the Zoning Ordinance. <br />17. In the event of significant changes to the originally-approved operation of the <br />subject facility, the City may require evidence from Verizon Inc. documenting <br />that the subject facility is operating within the allowable F.C.C. regulations. <br />
