<br /> 7A <br /> Page 1 <br /> REPORT <br /> To the Honorable Mayor and City Council <br /> From the Oi~ Manao.,er <br /> EXECUTIVE SUMMARY <br /> July 24, 2006 <br /> Subject <br /> City staff has prepared a Draft Lagoon Bank Policy ("Policy") with the intent of setting forth some <br /> construction guidelines for waterfront properties on the Redwood Shores Lagoon ("lagoon"). <br /> Recommendation <br /> Staff recommends the adoption of the Redwood Shores Lagoon Bank Policy & Construction <br /> Guidelines as recommended by the Planning Commission at their June 21, 2005 and September <br /> 20,2005 meetings. Furthermore, staff recommends the removal and/or modification of existing <br /> improvements that have been classified with "Level 3" significance and recommends that those <br /> properties that have been identified with uLevel1" significance as outline in the Waterfront Inventory <br /> be "grandfathered"; thereby allowing these properties to retain their improvements upon the <br /> recordation of an Encroachment Agreement. <br /> Issues <br /> The purpose of the Policy is to maintain the integrity of the lagoon slope. assist in the maintenance <br /> of a clean water way, protect the public health and safety of Redwood Shores residents, as well as <br /> to preserve the aesthetic quality of the lagoon and surrounding neighborhoods. <br /> In support of the Policy, City staff has conducted a Waterfront Inventory to identify the level of <br /> conformity (or nonconformity) of existing construction on the Redwood Shores Lagoon Bank and <br /> then has categorized the nonconforming improvements I waterfront properties into several levels of <br /> significance (I.e., Level 3 and Level 1, defined below). These categories work to identify which <br /> waterfront improvements represent a potential concern to the public health and safety and the <br /> overall stability of the Redwood Shores Lagoon Bank. <br /> Under the Policy those properties identified with Level 3 significance would be required to repair, <br /> modify or remove the portion of the improvement(s) that is considered nonconfonning (or address <br /> any life safety issue(s) when dealing with a confonning improvement}. Those properties identified <br /> with Level 1 significance would be required to either record an Encroachment Agreement on the <br /> property ("grandfathered") or modify/remove the nonconforming improvement(s}. <br /> The Policy has been organized to address two primary issues; 1} "new" improvements on the lagoon <br /> bank by providing appropriate guidelines and design criteria, and 2) repairs, replacements and/or <br /> removal of existing improvements that have the potential to create slope failure. In order to support <br /> these two primary functions the Lagoon Bank Policy establishes an application procedure. an <br /> exception procedure and an appeal process with the intent of establishing a Policy that can be <br /> consistently applied over time by all City Departments that will result in consistent and fair treatment <br /> of residents who own waterfront property. <br /> --...- <br />
