<br /> 7A <br /> Page 2 <br /> REPORT <br /> To the Honorable Mayor and City Council <br /> F'rqm t", CL i M~"a $r <br /> July 24, 2006 <br /> Subject <br /> Redwood Shores Lagoon Bank Policy and Construction Guidelines. <br /> Recommendation <br /> Staff recommends the adoption of the Redwood Shores Lagoon Bank Policy & <br /> Construction Guidelines as recommended by the Planning Commission at their June 21, <br /> 2005 and September 20. 2005 meetings. Furthermore, staff recommends the removal <br /> and/or modification of existing improvements that have been. classified with "level 3" <br /> significance 1 and recommends thatthose properties that have been identified with "level 1 ;, <br /> significance2 as outline in the Waterfront Inventory be "grandfathered"; thereby allowing <br /> these properties to retain their improvements upon the recordation of an Encroachment <br /> Agreement. <br /> Background <br /> In February 2006, staff presented the Draft Redwood Shores lagoon Bank Policy and <br /> Construction Guidelines ("the Policy") for your review and consideration. The purpose of <br /> the Policy is to maintain the integrity of the lagoon slope, assist in the maintenance of a <br /> clean water way, protect the public health and safety of Redwood Shores residents, as well <br /> as to preserve the aesthetic quality of the lagoon and surrounding neighborhoods. The two <br /> primary functions of the Policy are to establish a framework for permitting "new" <br /> construction and to address issues identified with "existing" improvements on the Redwood <br /> Shores Lagoon bank that have the potential to create slope failure. <br /> By identifying typical sections and establishing a series of zones the Policy looks to provide <br /> guidelines for construction within each zone, while maintaining the integrity of the existing <br /> lagoon bank. Given the variety of conditions and set of potential circumstances each <br /> waterfront property and each application will be reviewed on its individual merits. The level <br /> of City review will depend on the location of the subject property, the specific portion of the <br /> lagoon bank, and the scope of work proposed. However, as with any City review process <br /> where circumstances may vary the Policy has included both a process by which an <br /> applicant can apply for an exception and/or file an appeal of a decision. <br /> In support ofthe Policy, City staff has conducted a Waterfront Inventory to identify the level <br /> of conformity (or nonconformity) of existing construction on the Redwood Shores lagoon <br /> Bank and then has categorized the nonconforming improvements / waterfront properties <br /> 1 Level 3 Significance. represented the properties with waterfront improvements that have fife safety <br /> issues or potentially significant structural issues. <br /> 2 Level 1 Significance - properties with waterfront improvements that have a minor potential to <br /> compromise the integrity of the lagoon bank. <br /> .._...._u ,..._._._.. <br />
