<br /> 7A <br /> Page 3 <br /> into several levels of significance (Le., level 3 and level 1, defined below)3. These <br /> categories work to identify which waterfront improvements represent a potential concem to <br /> the public health and safety and the overall stability of the Redwood Shores Lagoon Bank. <br /> Of the 565 waterfront properties surveyed, 186 properties were Identified with some form of <br /> nonconforming improvement(s). Forty-one (41) of the 186 properties were classified with <br /> level 3 significance. For those properties with level 3 significance property owners would <br /> have the opportunity to apply for a retroactive permit. to repair. modify or remove the <br /> portion of the improvement(s) that are considered nonconforming (or address the life safety <br /> issue(s) when dealing with a conforming improvement) per the procedures established in <br /> the Policy. Upon compliance the property would be removed from the inventory. If the <br /> nonconforming improvement cannot be entirely removed or modified without potentially <br /> causing additional harm to the lagoon bank the improvement would be mitigated to the <br /> greatest extent possible, at the discretion of the City. The property would then be <br /> reclassified to level 1 significance. <br /> The remaining 145 properties were classified with Level 1 significance. Pending the City <br /> Council's . approval . the . properties . identified with level 1 significance would be <br /> "grandfathered" in as existing construction following the recordation of an Encroachment <br /> Agreement. (See Attachment 2 for a sample Encroachment Agreement). The <br /> Encroachment Agreement will be used to: <br /> 1. Identify the specific property <br /> 2. Establish the terms and conditions of the agreement <br /> 3. Provide a detailed description of the "grandfathered" improvements. and <br /> 4. Record a signed document <br /> Should a property owner choose not to record an Encroachment Agreement on their <br /> property they would have the opportunity to modify and/or removed the improvement(s) in <br /> accordance with the proposed Policy, thereby eliminating the need for the Encroachment <br /> Agreement. <br /> leve~ Qf 5i nifi~n,ce 'RepOmrn~Fldation <br /> Record Encroachment Permit <br /> Level 1 . properties with a minor 145 ("grandfathering" improvements) <br /> potential to compromise the OR <br /> integrity of the lagoon bank.
