8�� <br /> GENERAL PLAN CONFORMANCE <br /> The proposed Zoning Ordinance amendments are consistent with General Plan <br /> land uses and policies. The proposed changes, with modifications, generally <br /> only allow continued nonconforming uses ttat are legally established and that <br /> have little impact on neighboring properties. ^xpansion of nonconforming uses <br /> and enlargement of nonconforming structures is restricted in ways to assure <br /> incremental improvements in compliance with the General Plan and the Zoning <br /> Ordinance. These new regulations update sections of our Zoning Code which <br /> are unclear and confusing; therefore, these amendments are determined to be in <br /> the public interest. <br /> CONCLUSION <br /> Staff believes that the proposed modifications relating to nonconforming parking <br /> conditions will further the objectives of the Zoning Ordinance, because they: <br /> • Allow the continuation of legally established uses and structures where they <br /> are not offensive to neighboring properties; <br /> • Assure that properties become more conforming as prior uses are <br /> abandoned or as rebuilding occurs; <br /> • Provide flexibility, through the Use Permit process, to determine whether <br /> some expansion or change of nonconforming uses and structures is <br /> approp-iate, given specific site circumstances; and <br /> • Provide clarity for staff and applicants as to how nonconforming provisions <br /> are to be applied. <br /> Subsequent to Planning Commission action, the Commission recommendations <br /> will be forwarded to the City Council for a public hearing and final action. <br /> Curtis Williams/Charles Jany Michael Church <br /> Contract Planner/Principal Planner Planning Director <br /> ATTACHMENTS: <br /> 1.
