�B � <br /> . ,_ <br /> 2.2 DesiQn of Facilities Not Located on SBSA's ProQertv <br /> City will be solely responsible for the design of, and preparation of Construction <br /> Contract Documents for, all other facilities which are part of the Project but not <br /> located on SBSA's property including, without limitation, transmission and <br /> distribution pipelines, other storage reservoirs and pumping facilities, standby <br /> connections to the potable supply, customer service laterals and meters, and on- <br /> site customer plumbing retrofits such as piping and back-flow prevention <br /> assemblies. <br /> 3.0 PERMITS _ <br /> 3.1 Permits for Construction of Facilities on SBSA's Property <br /> SBSA will be responsible for securing all permits and other governmental <br /> approvals necessary for construction of Project facilities on SBSA property. With <br /> respect to approvals from City the Parties recognize that, while the facilities must <br /> be consistent with City's General Plan and Zoning Ordinances, a City building <br /> permit is not required, pursuant to Government Code Section 53091. SBSA will <br /> inform City, within thirty (30) days after the Effective Date, of the permits and <br /> other governmental approvals it believes will be necessary for construction. <br /> Thereafter, SBSA will provide City with a draft of each permit application at least <br /> ten (10) business days before submitting such application to the regulatory agency <br /> and will give thoughtful consideration to any comments City provides. SBSA <br /> will comply with the California Environmental Quality Act (CEQA) to the extent, <br /> if any, required in light of previous Project CEQA review and documentation. <br /> -5- 1091374.7 <br />
