�•��' �� <br /> 3.2 Permits for Construction of All Other Facilities <br /> City will be responsible for securing all permits and other governmental approvals <br /> for all Project facilities not located on SBSA's property. <br /> 3.3 Permits for Operation of Proiect <br /> SBSA and City shall jointly apply for approvals from the California Department <br /> of Health Services (DOHS) and the San Francisco Bay Regional Water Quality <br /> Control Board (RWQCB). The Parties anticipate that this will be accomplished <br /> by filing a Notice of Intent with DOHS and/or RWQCB, as appropriate, <br /> accompanied by: <br /> • an Engineering Report meeting the requirements of 22 CCR §60323 and the <br /> DOHS "Guidelines for Preparation of Engineering Reports for the Production, <br /> Distribution and Use of Recycled Water" as of the Effective Date of this <br /> Agreement; and <br /> � a Water Reuse Program Technical Report meeting the requirements of <br /> RWQCB General Order 96-011, Attachment B. <br /> Advertisement for bids for construction of the Project facilities on SBSA's <br /> property, or the first component thereof, shall not be published until the above- <br /> mentioned Engineering Report has been approved by DOHS and all other <br /> entitlements for construction have been approved or issued. <br /> RWQCB General Order 96-011, Section C allows certain responsibilities imposed <br /> by that section upon the "producer" of Recycled Water to be undertaken instead <br /> by the "distributor," in which case the producer and distributor must provide the <br /> RWQCB an agreement allocating their respective responsibilities. <br /> -6- � 09 � 3�a.� <br />
