19 (c) Avigation Easement <br /> (i) Prior to the submittal of the first PC Permit application, the developer will use its be�`. <br /> efforts, including mediation if appropriate, to reach agreement with the County of San - <br /> Mateo for an avigation easement to be recorded on the area governed by this Precise <br /> Plan and provided to purchasers of individual residential units. Should the above <br /> agreement not be reached, a condition will be incorporated into the first PC Permit <br /> requiring an avigation easement, acceptable to the City in consultation with the Countv, <br /> to be recorded on the area governed by this Precise Plan and provided to purchasers of <br /> individual residential units. <br /> (ii) Along with the avigation easement, purchasers of individual units will be provided a <br /> document, acceptable to the City in consultation with the Countv, which summarizes the <br /> provisions of the avigation easement using understandable terms. Amona other things. <br /> the document will disclose that: <br /> • There mav be aircraft noise disturbance to those who live and work in the <br /> Proiect; <br /> • Aircraft have a riqht to flv over and near the Proiect consistent with the <br /> provisions of the aviQation easement; and <br /> • Owners of Proiect residential units have waived their riqhts related to aircraft <br /> noise levels that are below those established in the aviqation easement and <br /> qenerated bv aircraft operating in a lawful and non-neqlipent manner. <br /> (iii) It is the policy of the City Council to minimize noise disturbances in existing <br /> Redwood City residential neighborhoods. Therefore, except to protect public safety, the <br /> City will not support any effort, resultinq from this Proiect, to chanqe San Carlos Aimort <br /> fliQht paths existinq as of June 7. 2004 awav from the Proiect. This Council policv shall <br /> be included within the disclosure document referenced in the above qaraqraph 19(c) (ii). <br /> 19 (d). ALUC/County Airport Manager Advisory Review. The developer shall submit a <br /> set of final building plans for each construction phase of the project to ALUC staff and to <br /> the County Airport Manager for staff level review of architectural and design elements to <br /> ensure the safe passage of aircraft in flight in the vicinity of the project site. Such <br /> elements shall be limited to reflective glass, site lighting, building lighting, size, type, and <br /> location of communication equipment, size and locations of HVAC exhaust vents, flag <br /> poles, water features that may attract birds, and other design items to the extent in <br /> which they may impair the normal and safe operation of aircraft. The ALUC staff and <br /> County Airport Manager review comments and/or suggested revisions are advisory <br /> only. <br /> Add new Condition No. 84 under the new category: Public Notification of Bair <br /> Island Refuge and Surrounding Open Space: <br />
