A _ � <br /> Bird Collisions into Towers <br /> The EIR did recognize that Project related bird collisions would occur as part of the <br /> project It examined the issue of bird collisions and suggested some mitigation <br /> measures such as minimizing exterior night-lighting and focusing exterior light <br /> downward, and to shut off ext��rior lighting when not in use. However, even with these <br /> • mitigation measures, the EIR c.,�ncluded that some collisions are inevitable and would <br /> constitute a "significant unavoidable impact". <br /> Public Notification to Marina Shores Residents Regarding Bair Island Refuge and <br /> Surrounding Open Space <br /> The City Council expressed some interest in having public information available to <br /> future residents of Marina Shores Village notifying them of the adjoining Bair Island <br /> Refuge and public open space. The intent was to inform residents so they could enjoy <br /> and take advantage of the Refuge. This information would be disseminated via flyers, <br /> kiosks, and other foRns of communication. The Developer has agreed to provide this <br /> information to the residents. Staff, however, would like to include the following condition <br /> in the Precise Plan to assure that it is implemented: <br /> To be added as Condition No. 84 under the new category: Public Notification of Bair <br /> Island Refuge and Surrounding Open Space. <br /> The developer shall submit a proposa/ to the City for preparation and <br /> dissemination of a public information p/an outlining how the future residents of <br /> Marina Shores Village will be notified of the adjacent Bair Island Refuge and <br /> surrounding open space. The developer shall implement the plan as approved <br /> by the City. <br /> Avigation Easement <br /> The City Council, in response to comments by the San Carlos Pilots Association and <br /> Centennial Neighborhood, asked if the City could require an avigation easement in the <br /> Precise Plan, even though negotiations between the developer and San Carlos Airport <br /> are currently on-going. In response to this request, staff is recommending the following <br /> additional condition: <br /> To be added as Condition 19 (c) to the Precise Plan: <br /> 19 (c) Avigation Easement <br /> (i) Prior to the submittal of the first PC Permit application, the developer will use <br /> its best efforts, including mediation if appropriate, to reach agreement with the <br /> County of San Mateo for an avigation easement to be recorded on the area <br /> governed by this Pr�ecise Plan and provided to purchasers of individual <br /> residential units. Should the above agreement not be reached, a condition will be <br /> incorporated into the first PC Permit requiring an avigation easement, acceptable <br /> 4 Marina Shores Village EIR.
