<br /> 1.Ø~5 <br /> Quality of Water SBSA will deliver water that meets the requirements of Title 22 <br /> CCR 60301.230 (b) in effect upon date of agreement. <br /> Timing of Deliveries City responsible for submitting annual customer demand estimates <br /> in monthly increments for following fiscal year, and continuous <br /> updates if and as customer demands change during the year. <br /> SBSA responsible for meeting demand on continuous basis, up to <br /> the maximum Production Rate <br /> Treatment Operations SBSA will operate the recycled water production facilities in <br /> accordance with applicable permits and the Operational Plan in the <br /> Engineer's Report. <br /> Maintenance & Repair SBSA responsible for SBSA owned facilities, City responsible for <br /> City owned facilities. SBSA will also maintain the- chemical <br /> disinfection facility' <br /> Interruptions in Supply SBSA will operate with the objective of providing a continuous <br /> supply of recycled water to the City. The parties recognize that <br /> scheduled maintenance and emergencies may occasionally <br /> interrupt delivery. <br /> Reimbursement of Costs City will reimburse SBSA for costs incurred for planning and pre- <br /> design of the recycled water project facilities located at SBSA, <br /> accrued prior to the effective date of the agreement. <br /> City will reimburse SBSA for costs of design and construction of <br /> facilities that will be transferred to City ownership. <br /> Annual operating costs shall be paid to SBSA by City on an <br /> annualized, budget basis, with year-end actual costs reconciled via <br /> a City reserve with SBSA, for the Recycled Water Project. <br /> Term Indefinite <br /> Indemnification & Insurance Standard provisions <br /> Resolution of Disputes Progressive through staff, management, Council/Commission, to <br /> non-binding mediation. <br /> 2 of2 <br /> -~ <br />
