The Legislature hereby finds and declares all of the following: <br /> . <br /> (a) Throughout the County of San Mateo, there are concerns about the <br /> adequacy of the existing park and recreation systems to serve the population <br /> of the Coun~y and its cities, including deferred maintenance problems, on- <br /> going maintenance and operations shortfalls, needed capital improvements, and <br /> missed opportunities for potential additions to city and county parks. <br /> (b) Formation of a park and recreation district in the County of San Mateo <br /> is critical to address these unresolved concerns and to provide safe and <br /> accessible park and recreation facilities for current and future generations. <br /> SEC. 2. Section 5506.13 is added to the Public Resources Code, to read: <br /> 5506.13. (a) A proceeding for the formation of a regional district in San <br /> Mateo County may be initiated by resolution of the Board of Supervisors of <br /> the County of San Mateo, adopted after a hearing noticed in accordance with <br /> Section 6064 of the Government Code, in lieu of the petition and related <br /> proceedings specified in this article. <br /> (b) The resolution shall do all of the following: <br /> (1) Name the proposed regional district and state the reasons for forming <br /> it. <br /> (2) Specify that the proposed regional district shall be governed by <br /> members as specified in the district formation measure to be placed before <br /> the voters. <br /> (3) Specify the territory to be included in the proposed regional <br /> district. The territory of the proposed regional district may include all or <br /> part of the territory within San Mateo County, and may include incorporated <br /> cities within that territory. <br /> (4) Describe the methods by which the proposed regional district will be <br /> financed. <br /> (5) Call, and give notice of, an election to be held in the proposed <br /> regional district pursuant to subdivision (b) of Section 5514. <br /> (6) Prescribe any other matters necessary to the formation of the proposed <br /> regional district. <br /> (c) .For purposes of this section, "regional district" means a district <br /> formed pursuant to this section that contains all or part of the territory <br /> within San Mateo County, and may include all incorporated cities within that <br /> territory. <br /> (d) The formation of the regional district is not subject to Section <br /> 5517.1 or to the Cortese-Knox-Hertzberg Local Government Re~ganization Act <br /> of 2000 (Division 3 (commencing with Section 56000) of Title 5 of the <br /> Government Code). <br />
