<br /> 6.10 <br /> Page 1 <br />August 28, 2006 <br />Subject <br />Agreement for Environmental Professional Services - Wagstaff and Associates <br />Recommendation <br />By motion, approve the professional services agreement with Wagstaff and Associates for <br />Peninsula Park and authorize the City Manager to execute contract documents. <br />Background <br />The City is in receipt of an application from Glenborough - Pauls, LlC for development of the <br />Peninsula Marina portion of the project area formerly known as Marina Shores Village. The project, <br />as currently proposed, consists of 796 residential units; 10,000 square feet of neighborhood serving <br />retail; a 200 room hotel; a marina; and a community park on a 33 acre waterfront site. Building <br />heights are proposed to range between 24 and 120 feet and would include a variety of typologies <br />including 1 O-story feature buildings, five-story lower-rise structures, and two-story townhouse style <br />building forms. At this time, the project plans are considered to be at a concept level only. <br />Previously, Wagstaff and Associates prepared an Environmental Impact Report (EIR) for the Marina <br />Shores Village project. That project was significantly larger in scope in terms of both land area and <br />build-out. Marina Shores Village included both the Peninsula Marina and the Pete's Harbor site. This <br />proposal does not include Pete's Harbor. The EIR for Marina Shores Village was certified by the <br />Planning Commission on July 8, 2003. The City will need to prepare additional environmental <br />review for the new project as required by the California Environmental Act (CEQA). It is anticipated <br />that an Addendum to the Marina Shores Village EIR will be the appropriate method for evaluating <br />the potential environmental impacts ofthe Peninsula Park proposal. In this case, an Addendum will <br />consider the effects of the new proposal in comparison to the original project as well as one of the <br />original alternatives. The work product will be a comprehensive, stand-alone document. In the event <br />that new information determines that another approach is more appropriate, such as the preparation <br />of a Supplemental EIR, the scope of environmental review will be amended to do so and Council will <br />be informed. The Planning Commission will subsequently review the resulting environmental <br />document in a public forum. <br />Staff has selected Wagstaff and Associates to prepare the Addendum in that they are the most <br />qualified firm based on their long work history with the Marina Shores Village EIR. The firm was <br />originally selected because they have extensive experience in preparing similar EIRs for comparable <br />waterfront projects, and they are very knowledgeable with the associated environmental issues. <br />Wagstaff and Associates attended the recent public information meeting held on July 11th before a <br />joint session of the Planning Commission and Architectural Review Committee. They understand <br />that there will be early public comment on this project and that their scope of work as well as the <br />concept level plans may be impacted by these initial comments. They have also designed their <br />schedule to relate to the public participation program which is currently being scheduled. Wagstaff <br />and Associates have also submitted a sample EIR Addendum that they prepared for another city as <br />an example of a comprehensive EIR Addendum.
