Ownership of the Documents, in accordance with Sedion 7; <br /> - 3. The obligation to perform in accordance with the Project Schedule, as prrnided <br /> in Section 8; <br /> 4. The obliqation to maintain and retain records in connection with the Services'� � F°`m'�aa' a,i�ess °w N°mne"°° <br /> and to �rovide Citv and Aaencv with access to those records in accordance <br /> with Section 10; <br /> 5. The obligation to defend, indemnify and hold hartnless the City and the <br /> Agency, as described in Section 12 <br /> I 6. The obligation to obtain insurance and provide evidence of insurance as <br /> described in Section 13; and <br /> I 7. Such other and further obligations as may be reasonably necessary to effed <br /> the purposes of this Agreement. <br /> H. Developer shall provide City and Agency with complete copies of any or all of its <br /> � agreements with Contractors and Consultants upon written request. <br /> I. Personnel of City and Agency shall have access to the Project Site at all times during <br /> performance of the Services. Developer shall notify the Agency and the City in writing as each of <br /> the activities described in section (A) (i) and (ii), above, has been completed. <br /> J. Maintenance of Work; Warranties. The Developer shall, directiv or throuqh its <br /> Contractors protect and maintain the Pubtic Parking Facility in good and safe condiGon until the <br /> Project is complete and the City and Agency have accepted the Public Parking Facility. Prior to <br /> such acceptance, the Developer shall be responsible for protecting the improvements and <br /> performing any required maintenance at Developer's sole cost and expense.
