ZT: 2003-01 -(Article 32 - Supplemental Provisions) <br /> ZT: 2003-02 -(Article 37- Accessory Dwellings) <br /> ZT: 2003-03 - (Article 41 - Amendments) <br /> PROJECT PLANNER: Tom Passanisi, Principal Planner <br /> APPLICANT: City of Redwood City <br /> RECOMMENDATION: <br /> 1) Adopt Resolution of Intention to Amend the Zoning Ordinance <br /> 2) Recommend to the City Council that it adopt the attached Zoning Text Amendment <br /> Ordinances which will do the following: <br /> a. Amend Article 32 (Supplemental Provisions) to conform to recently enacted <br /> state law as it relates to the review and granting of density bonuses. <br /> b. Amend Article 37 (Accessory Dwellings) to conform to recently enacted state <br /> law related to the city's discretionary review of accessory dwelling units and <br /> establish objective criteria for architectural review. <br /> c. Amend Article 41 (Amendments) to also allow City staff to initiate zoning <br /> amendments. <br /> PUBLIC HEARING: Yes. Notice published in the Independent on July 19, 2003 <br /> BACKGROUND: <br /> ARTICLE 32: SUPPLMENTQL PROVISIONS (Density Bonuses) <br /> The new State law enacted on July 1, 2003, amends how a City may review the <br /> granting of density bonuses and allows for density bonuses for moderate income <br /> units. More specifically, upon a developer's request for a density bonus, the Ciry <br /> is now required to grant the density bonus and at least one other incentive unless <br /> certain written findings are made. If the City fails to grant the requested bonus, a <br /> developer may initiate legal proceedings and recover attorney's fees. <br /> The changes are as follows: <br /> • Under the current law, residential projects that include at <br /> least 20% of the units for low income residents, 10% for very <br /> low income residents, or 50% of the units for senior citizens <br /> must be granted at least a 25% density bonus over and <br /> above the normal maximum residential density allowed by <br /> Zoning.
