<br />,s..se-/ <br /> <br />REPORT <br /> <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />June 20, 2005 <br /> <br />Subject <br />Adoption of Administrative Policy No. 36 <br /> <br />R ecomme ndation <br />It is recommended that the City Council approve a resolution that adopts Administrative <br />Policy No..36 which provides authority to the City Manager to do the following: 1) execute <br />certain membership agreements, 2) execute certain multi-year lease and tenancy <br />agreements, 3) enter into certain agreements under which the City is providing a service, <br />and 4) execute certain fiscal agent agreements. <br /> <br />Background <br />In December 2002, the City Council adopted Ordinance No. 2238 that established, among <br />other matters, the limits of contracts that the City Manager may enter into without Council <br />approval. In November 2002 the Council also adopted Resolution No. 14476 which <br />prescribes limits of general liability claims and workers' compensation claims that the City <br />Manager may settle without Council approval. <br /> <br />With the adoption of the ordinance in December 2002, staff's intent was for Council to <br />grant the City Manager signature authority for all expenditures under $60,000. However, <br />the City Attorney's office has advised staff that there are several other business <br />transactions where the approval of which is not specifically defined in the December 2002 <br />ordinance. By default, each of these items must be submitted to Council. Council <br />approval of this administrative policy will "clean up" the ordinance that Council approved in <br />December 2002 saving staff and Council a great deal of time and keeping in line with <br />Council's priority of doing business more effectively and efficiently. <br /> <br />The following areas have been identified as areas that were not specifically covered in the <br />December 2002 ordinance, and thus staff recommends the following limits under which the <br />City Manager may execute such agreements: <br /> <br />Membership Agreements - It is recommended that the City Manager be authorized to <br />execute agreements, such as the City's membership in the League of California Cities, <br />where the dues do not exceed $60,000 per year. By way of information, currently, there <br />are three memberships that fall within this category: the League of California Cities <br />($17,000), Association of Bay Area Governments (ABAG) ($11,170), and Peninsula TV <br />($40,000). <br /> <br />Multi-Year (and agreements less than one year) Lease Agreements - It is <br />recommended that the City Manager be authorized to enter into agreements, such as <br />leases for storage of City records, office space, or leases of personal property, where the <br />annual lease payments do not exceed $60,000. <br /> <br />1 <br />
